Excerpts from: Amendments and New Laws Effective January 1, 2008 [Notary Handbook-California Secretary of State]

  •            The certificate of acknowledgment now is executed under penalty of perjury (Civil Code section 1189)
  •            In addition to the background check by the Department of Justice, notary public applicants' fingerprints will be submitted to the Federal Bureau of Investigation for purposes of a background check. (Government Code section 8201.1)
  •            The notary public journal must contain a notation that the identity of the person making an acknowledgment, or taking an oath or affirmation is based on "satisfactory evidence" and not "personal knowledge" (Government Code section 8206)

Perjury is punishable by imprisonment in the state prison for two, three or four years.

     Prison overcrowding is not caused by all of the notaries awaiting execution on death row.  Still, average Americans do not fully appreciate the seriousness of the position that we hold in today's society.  Certainly, there are less professional Notaries Public that wil do your bidding.  But, if you are looking for a professional Notary Signing Agent, look for the one who asks signers for their ID, takes thumbprints and asks you to raise your right hand when an affidavit is being executed.

People fail to realize that we play a very important role in all aspects of legal to business transactions.  We are ministerial officials of our states.  Sometimes, it very irritating when people do not respect what we do and the risks we take rendering services to them.  Lately, I have been getting calls from people asking for services and attempting me to notarized documents at their discretion which would result in volations against state guidelines.  Family and friends are at times the biggest offenders because they feel they can get you to notarize just about anything.  As you can tell, this is a subject that hits at the core for me.  All I can say, is don't do something that will hurt you later.

The usual citizen in CA doesn't understand the Notary  profession.  Most people think we can notarize a document and make it legal. We don't notarize documents, we notarize signatures.
