Illegal, Immoral, Unethical? No, - Just Bad Business Practice

 

All of us who represent buyers have experienced the sting of losing out in a competitive offer environment.  It’s part of the business and something we better learn how to handle ourselves and be able to advise our clients on how to handle it too.  I’m Ok with all that.

 

On Monday of this week I helped a buyer submit an offer on a property she coveted. We were aware there was a competing offer but felt good about our chances with a full priced, cash offer.  At 10PM Monday night I received a call from the listing agent letting me know the seller would be sign our offer with a minor revision to which we readily agreed.  I sent an email to my clients letting them know the good news.  I booted up my computer Tuesday morning to an email that said, “so sorry, seller signed the other offer”.  No explanation, no discussion, no chance to sweeten the deal, it’s over.

 

 

 

I get it that this is NOT, Illegal, Immoral, or Unethical.  The seller has the prerogative to sign the offer they want.  But bad business practice making this agent look bad, Oh yes!

Brian, we are seeing this frequently too.   The agent recommends one, the seller takes another.  It does sting!

Brian - Back in the days when we were writing offers on homes that had multiple offers, my clients lost out on a couple of deals with no explanation. The listing agent and seller never came back to us asking for highest and best, or tried to negotiate anything, so they never knew what they may have missed out on in regards to a higher sales price, etc. I was surprised that with multiple offers, a seller wouldn't ask for highest and best from every buyer who made an offer, but that didn't always happen.
