The EPA has finalized the new Waters of the US (WOTUS) regulations. These sweeping regulations would allow increased costs and permitting to be required to develop any real estate that is even remotely located near a waterway. In Tucson, that means that a lot located near a wash that runs less than a few days a year could be considered to be near a waterway and could be subject to these new rules. Fortunately, a lawsuit filed in Federal court resulted in a ruling that blocked enforcement of these new rules in Arizona and 12 other western states. NAR continues to work to pass legislation to repeal these rules nationwide.
