Normally, consumers who are in the process of a divorce have to wait till the divorce is final to obtain final loan approval. This is due to having to wait for court confirmation of any liabilities coming from the divorce, such as child support or alimony. There are exceptions, however. When there are no minor children and the filing evidences no liabilities for the borrower in the divorce, final approval may be obtained and loans closed prior to the divorce being final. This is a case-by-case situation so the consumer should consult their lender before buying or refinancing during a divorce. Arizona is a community property state.
