Who do you have representing you in a home buying transaction? The most common situation is the home buyer using the listing agent's services.This is known as a transaction broker. In this representation the agent can assists both the seller and buyer. It is also possible for the buyer to ask another agent to assist in the purchase and represent their interests exclusively. This agency of a buyers agent is available at no cost to the home buyer.

Any Real Estate agent can act as a buyer agent to help you find a home with your criteria in your price range. When a potential home is listed with the same brokerage as the buyers agent, duel agency applies. The buyer's agent will advise how to handle termite damage or significant material defects that have been uncovered in a home inspection. If the appraisal should come in less that the contract price, the buyer's agent will negotiate with the lender and the seller's agent to come to a satisfactory resolution.

Mark.. I've been in the real estate business for years.  Over this time, I have done both sides of the transaction from time to time.  During this whole process, and stated over and over to each party, that at the time I work with the buyer I only represent their best interest, and when I am with the seller I only represent their best interest.  Both parties also sign an agreement to this as well, to where I am representing both equally & individually.

Valerie- We all do our best in that situation, but do you really think that both sides benefit equally from duel agency? Human nature is to have both sides agree. That isn't always in the best interest of all parties involved.
