But I Thought...

 

How many times have we heard a buyer or seller say: "But I thought__________!''

Go ahead and fill in the blank.

These words are not something any of us want to  hear. This means there is some kind of misunderstanding.

Many years ago a buyer, after settlement, had her agent call me asking where the stained glass panel was. Her statement:

"But I thought it came with the house and we want it returned."

The agent, adamant about the art, had her manager call me.

 Note: the item was a personal piece of art, it was hanging from a hook over a side door panel, it was not attached.

 

The buyer, the agent and her manager suggested that an attorney be called to insure the piece of art was returned. 

 

I suggested we go back and take a look at  the contract. Was the item mentioned? Was it made part of the inclusions?  

The answer, of course was 'no' but again those dreaded words... "But I thought..."

The buyer felt, because it looked so good, that it was  part of the decor and was supposed to stay.

 

 I was told it should have been 'excluded' in the contract. My response if they wanted a piece of art that it should have been written in and negotiated at the time of  the offer. After all they didn't expect all the other hanging art to be left behind.

Hard feelings by the buyer, a seller who had already moved on and someone saying....

 

"But I Thought..."

I write everything in an offer as well, right down to bathroom mirrors. I've had several "But I thought..." occassions where it was assumed bathroom mirrors were excluded but we here in Halifax, Nova Scotia assume they are included. Nothing should be left to interpretation.

Yeah I dont care what you thought or why you thought it, as that is something I may not have any knowledge of unless you shared it with me BEFORE! If it was that important to you, you would have made it part of the contract to CLARIFY it!

This seems to hit "home" with many of your commentors! I actually had a story about having to remove a Moosehead New Years Day because the sellers left it, "I thought that since the former seller left it that it was a fixture"....NOPE! And the buyers wanted it GONE! At the New Year's Eve party at Fishhawk Lake I offered $100 to whomever could help me remove it the next day--had two takers immediately! We ended up surprising a friend/neighbor by putting it above his fireplace, something he'd always wanted but his wife had some kind of quilt over the fireplace (which he hated). He loved it and everyone was happy!

(I called my post The Three Mooseketeers because it took 3 of us to manhandle the darned thing, get it in the back of the rig and move it over to it's new home.)

I am in escrow right now where the sellers showed my buyer and myself the home without the listing agent present. The seller kept pointing out items saying "This goes with the house" and This goes with the house" and she must have done this 10-15 times while we were there. I checked the box everything the buyer wanted such as refrigerator, washer/dryer, stove  on the form  RPA (CA Resd. Purchase Agreement) so during negotiations, I get calls back saying the seller is unhappy at the negotiated price and is not leaving the _________ which is nothing we asked for in contract. I suggested that the listing agent advise her client not to say it if she doesn't mean it as someone may take her up on it. I feel everything should be in writing and this is a good reason why.

Simple rules are best Somtimes.  This is one of my favorite real estate rules.

If its not written  into  the purchase contract, Its not part of the purchase contract.

I advise sellers to take down things they do not want to sell with the home.  But who would have thought to take down a piece of art.

In Silicon Valley the sellers thought home prices will go up 10% higher than highest sold.  Now we got homes priced high that sellers need to reduce to get interest. Then when one get offers they think they can counter for much more....

I thought you realtors said home prices will go up up up?
