Landlord may deduct the back rent and cost of fixing damages form your security deposit. However, landlord can not keep your deposit for normal wear and tear such as worn carpet & chipped paint.

Landlord can only deduct the cost of fixing damages that is beyond normal "wear and tear" such as broken window or kid's crayon art work on the wall.

In California, tenant can not deduct the last month rent from the security deposit. Landlord must send the deposit refund to tenant within 21 days after move out.

Say it again!  I am so tired of landlords charging tenants for worn carpest and a dirty wall.  If the tenants have lived there for a few years and have kids please expect this, I always suggest that they have the carpets professionaly cleaned and clean the walls as best possible.  I am going to open up my own property management business soon, worked with tenants long enough it is time to go out on my own.  My tenants will be suprised on how fair I am.

There are a lot of amateur landlords (because they can't sell their house) that are totally clueless about this.  They think that the tenant must leave the house in perfect condition in order to see a penny of the deposit back.
