There is in Arizona an animal known as a "split" escrow where the Seller can insist on using ABC Title for Escrow and the Title Insurance the Seller purchases, and the Buyer is free to use any Title company they choose to purchase the Title Insurance that they need to purchase.  Since there is a discount to the Buyer they are faced with a choice - buy at ABC Title for a discounted price OR buy somewhere else for full filed rate... In Santa Clara County, when an agent takes a listing, it is customary that the seller open escrow. Actually the agent the sellers hire opens escrow.

Clearly if a seller directed their agent to open escrow at a particular title company, I'd like to think the agent would do as their client instructed. 

 

Once escrow is opened with the escrow officer at the title company, a Preliminary Title Report is ordered and delivered to the listing agent, generally within a day or two.  At least that is my experience. 

 

While I generally do not work in counties outside of Santa Clara County, I do know that in many other surrounding counties, it is customary for the buyer to choose the title and escrow company - buyers open escrow. 

 

With that backdrop - I will get to the point of this post. 

 

Why would a buyers' agent representing a buyer making an offer on a San Jose home for sale, knowing there will be multiple offers on the home, ask the listing agent if she minded if he used XYZ Title Company?

 

I am an advocate of "Don't ask - Don't get".  I am also an advocate of discernment.  That would not be a question I would ask the listing agent whose listing I am presenting an offer on behalf of my buyer client.

 

No harm in this situation. I simply advised the agent that escrow is already open and as I am sure he can understand, I prefer working with my escrow officer at Chicago Title Company.

 

My escrow officer is part of my team.  She is amazingly good at what she does. We have been working together for over 10 years.

 

I know from working with other escrow officers at other title companies that it is rare to find good escrow officers, let alone amazingly good escrow officers. 

 

I know with my escrow officer we will have a smooth escrow. If there are issues she advises me and anyone else who needs to know. Issues are resolved without drama and typically without delay.  That's why I've chosen to work with her. It's not random. It's not because she is my friend.  To note, we are not "friends" and do not socialize. We do business together.

 

She is amazingly good. There are about as many title companies surrounding the area where I live and work as their are nail salons and liquor stores.  I travel across town to another city for my title and escrow needs because exceptional service is more important to me than convenience. 

 

Providing exceptional service to my clients is what matters.
