North Richland Hills new construction, new homes in NRH, doggy day care, Amy Steele Realtor #NRHRealtor1. New homes at 7800 Starnes road. On the corner of Starnes and Smithfield across from the Wellspring church and storage facility.To be built by D'Lee Properties. Currently the property is zoned C1 commercial; application to change to RI-PD infill planned development on 2.27 acres. 7 lots for residential homes. Common private driveway in front of each lot with 2 driveway locations exiting to Smithfield so there aren't 7 driveways onto the street. 7000 sq ft open space. 12K to 17,003 sq ft lot size. 58 foot setback from Smithfield road.

Concern brought up about viability of HOA 20 years down the road. Landscaping wouldn't be an issue because of there not being a ton of grass and a sprinkler system put in place in the common areas. Should be a self managed HOA. One neighbor on Old Hickory spoke about the project, praising it because of the work that D'Lee properties did on the home they built on Starnes across from the church. He said that the home was beautifully done and would rather there be more beautiful homes instead of commercial or a vacant lot.

Wellsprings pastor spoke for the project as well.

Another neighbor, Lindwall Court that is directly behind this project spoke. Has 8 foot fence and concerned about a 2 story home looking down into their yard. Are the homes going to have their own fences or will they be sharing a fence? Another Lindwall Ct neighbor concerned about traffic and price of the homes beginning in the $360k range. She said she plans on being a very good neighbor but also concerned about privacy with a two story looking into their yards because all of the homes on their side are single stories. Third Lindwall Ct neighbor concerned about fencing issues also, who would be responsible for taking care of fencing that is damaged in storms etc.

Doug with D'Lee Properties thinks empty nesters would be the typical buyer they would get which would be single stories. They have 2 story plans and could have those built also because of the great schools in the area and it might be bought by a family that needs a larger 2 story home. He didn't envision the HOA to take care of fencing; that's on the individual homeowner which is usually what neighbors do. Fencing facing Starnes and Smithfield is HOA cared for but not the back fencing that is usually property owners care.

The lots are pretty deep and are more than the 20% rear yard requirement by the City of NRH. There might not be an issue with the house sitting and looking right into the yard of the neighbor.

Commission is for the project and feels it was a good fit because there are commercial uses on all three corners and this is a perfect addition. Approved.

 

2. 8415 Davis Blvd. Application from Mutt Shack for a dog day care and boarding behind the dry cleaner/Sonic/Ross. Interior space used to be a veterinarian office and is already set up to contain this kind of business. The Vela family is the applicant. Family owned and run business, very active in the community with animal rescue. Will have video cameras so owners can see their dogs during the day, exercise areas and doggie treadmills. Permission given already for green space usage by the owners of the center for dog walking.

Total number of dogs is maximum of 28 in boarding and 13 for doggie day care groups. If boarding is full they won't take day care dogs because those facilities would be used. Concern brought up about current vacant pasture land was ever developed with houses. Concern about future noise issues brought up however with the size of the land and any future fencing put in there should be enough buffer. Approved.

3. 7148 Hightower Dr zoning change request from Sempco Surveying from AG agriculture to R1S special single family residential. 1.091 acre north of Graham Ranch community. This area was designated as a rural preservation area because of existing estate areas. Livestock and horses are allowed in R1S setting. 100 foot setback from other homes for any horse/livestock enclosures. Could only have one horse. There are no plans to develop the property; the current owners of the property to the front of this flag shaped lot wanted it to have control over any future development if they wanted to allow it. The parcel was owned by the subdivision developer in case of any ingress issues and decided that it wasn't necessary anymore.

Goodnight Ranch road residents that back up to this parcel are against this application. They bought their lots specifically because the developer had kept this as a vacant lot. Greatly concerned about their homes' value with any future home developed on that lot. Concern about what their rights are as far as if its approved. Their homes look down into this lot already and they don't want to be looking down into someone's yard. The P&Z is only a recommending body and it's ultimately up to the city council. Clayton Comstock said the 20% yard requirement has to back up to the rear fence/southern property line and so the house would most likely face the north part of the lot. Concern too about headlights coming down the long driveway shining directly into their home. All neighbors bought because of trees and pasture. Concern too if there was a home developed how long it would take to sell and have this vacant house just sitting there.

P&Z discussion, probably not ever have a spec house. Approved with one nay.

4. Detention pond to slow down water drainage during heavy rain on the property at 6601 Glenview Dr and 4131 Rufe Snow Dr where the proposed Athlos Academies Charter school is considering locating. Tabled and continued to January 21st meeting.
