So is it the buyers fault or the buyers agent?

buyers agentHave had an absolute rash of damage in my listings recently and they all have something in common - they're vacant. Now they are in good shape, recently remodeled & detailed & there would be no need for any immediate work in these properties.

Disrespect?
Lack of control on the part of the agent?

So I'm confused as to why in one property the Master Bedroom storm window just 'flew' out of it's track & met it's fate on the grass below. No mention in the home inspection that the window was even smashed. Why not?  

Did the buyer do it?
Did the agent do it?
Who dunnit?

Now when I asked how did the storm window meet up with the backyard lawn there wasn't much buyers agentof an answer other than 'that's the way we found it'.

Really?  A few months ago the seller had all the windows & woodwork painted & that storm window was perfectly fine.

When meeting the gas company for a small leak I then noticed that one of the new 6 panel doors was off the track & the pins were broken in that brand new door.

Who dunn this?

So in another listing that I have there was a foyer 6 panel door that was wrenched from it's hinges & put into the closet with of course, no explanation. I typed up a small note & stuck it to the door that said an 'anonymous buyer' broke the door. No mention that the seller would repair because we did not break it!

So is it buyers that run around & destroy things OR is it agents that don't ask that buyers be courteous in someone else's home?  Is it the buyers children that run around unattended in the home so Mom & Dad can concentrate?

Last year when selling my fathers house buyers came with 2 teenage sons & 'that mysterious gorilla' literally ripped off the stationary cabinet fronts in the Master Bathroom.  So a drawer or cabinet doesn't open & let's just rip it right out?  When I went to shut off all the lights after the showing I was completely shocked & just popped back in the cabinet fronts.  But why did I have to do that?

I would have been mortified if one of my buyers had done this but I must be the only one.

Either way, somethings got to give & this has to stop. The buyers agent is responsible when entering that property with buyers that are 'guests' to the house.

Wow, Lyn! I'm gob-smacked at this story and yes, it is up to a buyer's agent to be responsible for the condition of a home when there with buyers. Fortunately, in all the years I've been in this business I've only every had two complaints post-showing. (In one case, the buyers actually purchased the home!)

Unbelievable! If damage had occurred while in the house, it was the agent's responsibility to notify you. If it was caused by their client, they need to fess up. I guess ethical behavior goes out the door when the storm door falls out!

THat's unusually bad behavior if it's kids in a home.  As I tell my buyers' children, "Miss Chris Ann doesn't tolerate nonsense.  Behave!"

Chrissi:  That's what the problem is - no one fesses up. Doors don't break themselves.

Lyn, That is really annoying and concerning as well. Dealing with New Construction, I can say I've seen destruction first hand TOO OFTEN. Believe it or not, sometimes its the neighbors. We caught neighbors 18 yr old son, trying to break into a house to destroy it. They had painted "Save the trees" on the white garage doors as well. We called the police, and it stopped after that, but should never have started to begin with!

Some people have no respect and some have no sense. I don't recall ever having a case of deliberate damage, but I do remember one little boy whose mother couldn't control him. We were trying to leave the house and I was turning off lights. He kept running back and turning them back on. I finally picked him up and carried him outside, with a threatening "Now STAY there!" 

His mother said "See, that's what happens when you aren't nice." 

If one of my children had ever behaved that way I'd have crawled under the carpet - right after I dealt with the child, of course.

Marte:  That's how I feel. When I open anything I never force it if it doesn't work.  I was also leaving my listing once & the showing agent told the kids to sit down & play with the sellers TV & computer. I was dumfounded & said 'nope', time for them to maybe play outside.

Ellen:  See, why would they do that? How are they being harmed? Odd folks.

Yes, lack of respect and kids on the showings.   I have told more than one parent that had kids along that were not behaving nice that anything broken would be a bill they paid

Lyn, I am shocked all this could happen, and even with our vacant homes, we are not seeing this type of activity.   So sorry to hear!

Wow ... just wow.  Sad that behavior has sunk to this level, Lyn Sims ... can't begin to imagine having let my boys behave this way.  Or not 'fessing-up if something happened while in the home.

Lyn- It's hard to believe that an agent or buyer wouldn't speak up if they broke something.  It's the right thing to do.

When a buyer is viewing a home, it is not a playground for kids. People do not respect other people's property, which is just so wrong. Are we at a level, where we need security cameras on each of your listings? Do you need to check the house everytime someone else shows the house? I would hope people are more responsible than that! Sorry to hear about your troubles.

If a vacant house has a few showings per day, it is hard to find out who coursed the damage, since no one wants to take a responsibility. If I show the house and notice any issue, I call a listing agent and let him/her know. Most of the times, it is unlocked doors or broken lockbox.

 Quite an rash of events that you have had to deal with Lyn even with your father's home. Poor training if the parents permit their kids to do these things and not take responsibility.  Ugh.

Those are horrible incidents! I have not seen buyers or agents that act like that. Did have neighborhood kids break into a vacant home, splashed paint all over the carpet, kitchen cabinets, vinyl flooring and poured some down the drain. Then they stole the central A/C unit that was outside. It happened to one property about 5 or 6 years ago.
