Don't pay fees upfront to those guaranteeing to sell your home as a Short Sale

Want to sell your home as a Short Sale in Coral Springs and the surrounding Broward County?

First and foremost, stay away from those who promise to sell your home for you as a Short Sale for a fee. RUN!!!

Some Service companies, Attorneys and/or Agents are seeking out the distressed homeowner facing foreclosure, knowing they're distraught and that they might do just about anything to save their home from foreclosure. Yes, these homeowners quite often think that if they scrape up enough money to pay for their services up front that it must really work; well, there is no guarantee that negotiating a short sale can work for any price. The only way to be guaranteed relief from your foreclosure is to have a buyer for your home, have your lender accept the buyer's offer and your home gets sold at closing. Now, at the closing is when Servicers, Attorneys, or Agents should be paid their commissions earned and not before for negotiating the short sale.

Preying on the distraught is how I view this practice. It's disgraceful. What incentive do they have to work for you if they've already been paid a fee up front which doesn't guarantee that you're home gets sold?

There are Service companies, Attorneys and/or Agents that charge for their services but only when your home is sold; big difference.

So when you're thinking of ways to avoid foreclosure, after it has been determined that your lender cannot work out any type of Loan Modification plan for you, then consider selling your home with someone knowledgeable about the Short Sale Process and with someone that you can respect having earned their fee and/or commission.

UPDATE: Please do not confuse my concerns here with the Attorneys who offer a valuable service to the distressed homeowner by offering them defense through the foreclosure process. This can be vital in the sucess of a short sale.

In California it's illegal to charge upfront fees for shortsales (or any real estate service) until the service is performed.

Lynn- I think this might be a little misleading. We need to clarify what exactly you are saying to not pay up front for.Most consumers do not know what a short sale is. So they will confuse what you are saying with foreclosure defense.  Some attorneys and companies combine the short sale along with foreclosure defense.  I do not know of any attorney who would take a case without a fee upfront. 

Brian ( our attorney) charges a fee of $650 to start all the foreclosure defense which would include doing the short sale processing because it kind of is all in the same boat. He also charges $500 a month for every month we avoid a foreclosure. I highly recommend this! We are not attorneys and as agents working with short sales there is a fine line between what is constituted as practicing law without a license to do so.

Katerina, no you're right in saying that the Foreclosure defense is great as what Brian provides. An attorney that goes and actually defends you in the foreclosure process is great to have on the homeowners side.  I'm referring to those that do not afford the homeowner this defense and make guarantees to save the homeowner from foreclosure simply by negotiating a short sale. These guarantees shouldn't be offered as there is no guarantee that the home can be sold. However, it's great to have an Attorney, such as Brian, to be on the homeowners side to allow the homeowner more time to achieve the short sale and come to the homeowners defense. No, I'm not referring to those practioners. I've heard of practioneers be it a service company, attorney, etc that will make guarantees of being saved from foreclosure and this guarantee is impossible without a successful short sale closing; simply negotiating a short sale doesn't guarantee success. I've spoken to homeowners who've paid over $1000 only to be left out in the street when their negotiator failed to negotiate the short sale. I hope I've clarified that better. In fact, I'll update my post.

Joe, yes I've heard of California taking that position in protecting the homeowner. Makes sense as I would never charge a fee up front to negotiate a short sale. I earn my commission when I sell the home. Thanks for commenting.

Lynn- Brian would never guarantee the outcome of a short sale and neither would we. I would definitely warn people from anyone offering a guarantee!

What I really think is disgusting is those companies that tell the homeowner to sign over their deed to them! And then go and negotiate a short sale that they then flip within the process!

We don't have many short sales/foreclosures and the few we do have....well, hardly any of us have done a short sale and the majority I have seen are agents doing their first short sale and knowing NOTHING about them. That's sad. They're walking around ...the blind leading the blind. You have some good points here.

Lynn -

I'm kind of hurt - but you did clarify yourself.

There are several ways to charge for short sale services.  I don't think one way is better than the other, but each has its good and bad sides.

Charging up front with a fixed fee (as we do) means we are bound by the rules of the bar mandated by the Florida Supreme Court to provide the service that we were contracted for.  And the faster we get the deal done the more money is left over as profit.  But yes, we got paid so who cares?

Brian's way of charging is also fair - if he is not trying to milk the client by dragging out the short sale, since every month he makes another $500, so why rush?

Getting paid at the end of the deal, for an attorney means taking a contingency fee, which most attornies will not take for a transactional event.  There may even be conflict of interest issues in taking a transactional continency fee since the incentive is to get the deal done rather than the best deal done.

So you can see, there is no perfect arrangement for the payment of the attorney.

Oh Richard, you are the last person that I would want to hurt and this post wasn't aimed at you by all means. I did not illicit all the responses that I had wanted as I should have clarified myself better in stating that my comments are truly aimed at those individuals who are seeking out the wounded person and making empty promises and guarantees on how they can save the homeowoner from foreclosure by guaranteeing them a positive outcome of keeping their homes.  I've updated my title of the post too!

As always you've made some very clear responses on how Attorneys should handle such and I feel that you would represent your customers in the most ethical manner and I'm glad to know that you're in my neck of the woods.

I hope I've taken away your hurt! Thanks Richard.

Cynthia, yes it's true as too many shady events occur with a short sale. It's a real shame when individuals who are supposed to be professionals get caught up in the idea of big money and choose the wrong path.
