Bigots are not a protected class

Under ECOA law, lenders are not allowed to discriminate against any applicant on the basis of race, color, religion, national origin, sex, marital status, age, or the receipt of public assistance.  Please note that within this list of protected classes, "Bigots" is not listed as a protected class.  I'm extremely thankful for this, because I refuse to do business with them.Mortgage Racism

Yesterday, I had a client inform me that she was having trouble getting a loan because she was white & American.  Huh?  Can you please send in the denial letter from another lender that says you were denied a loan because you're white & American?  I'm no lawyer, but I'm pretty sure we're making a pretty penny off the lawsuit I'll help you file!

"Also because I'm not  drug dealer".  Ohhhh, I see where this is going (ok, ok, I saw where this was going much earlier in the conversation).

So because you're white, American, and not a drug dealer, you can't get a loan?  That's odd, because I just funded two loans last week for white, non-drug dealing Americans with no trouble at all.  We've got another one funding next week.

It's hard to believe that in 2016 I still have to have conversations like this with people, but thankfully I don't have to tolerate them, and I certainly don't have to do business with them.  This particular person was a nurse, which is a terrifying proposition - she couldn't qualify because her hours were sporadic and her income varied over the past few years from 'next to nothing' to 'a little more than next to nothing', which she of course blamed on her skin color and nationality.

I'd venture a guess that the lack of hours are because perhaps her employer is familiar with her temperament and beliefs - I certainly wouldn't want her around caring for people of all backgrounds with her attitude and mindset.

You want help getting a mortgage?  Too bad.  I can turn you away for being a bigot.

Making deals "Happen"

John,

Congrats on the featured... Yes, they are out there and good that they are not protected. In 14 years of real estate sales I have only had to walk out on one bigot. This was so blatant I thought it might be the commission running a test. Sadly it wasn't, it was real. Funny thing is he NEVER got an agent to list the house.   Oh... and I can't even print what he said about who should not be allowed the see the house.  I walked out in the middle of his sentence..

Wow.  Crazy to see someone try the reverse racism routine.  Glad you passed on that client, not worth the headache!

I don't know if "bigot" best suits this woman . . . delusional, in denial, street rat cra-cra come to mind.  Yes, let's blame other people for her lack of ability to get a loan.  And actually, being white (a color) and "American" (which part, north or south?) is "origin" . . . so if those really were the basis for her denial, I'm right there with you!   She's being discriminated against, and boy howdy will a lawyer have a field day on that!  But, she's not been discriminated against.  She's just not qualified to obtain a loan . . . and that may be due to her own self (un)doing.  Funny read this morning John!

One time I was holding an open house and this guy came in and said 'where do the blacks live around here?".  I was just stunned.

I am always very careful about how I respond to people. Guard your words carefully when responding to statements that are inappropriate.

I once was in insurance and had a client come in and demanded I do certain things that were against the law. I carefully and consistently refused. The next day my manager called me to say that the State Insurance inspector was in my office the previous day, it was the supposed client.

We never know who we are dealing with. So CAUTION!!

Well I'm pretty sure the only reason I got the mortgage approved on my own home is because I'm mexican and the lender probably felt obligated to help out a minority.

It is quite a shame that conversations like this are still happening.  The sad part is that lady probably truly believes that.  Glad we all have the choice to walk away and do our business with other people lol!  Wow..

Not going Political here but Time Magazine had a great article of the appeal of "The Donald with bigots...well researched and interviewed "White Nationalist" who supported him...very disturbing. Worth checking out whatever your political affiliation. Interesting times we live in...

I refused a listing because the seller did not want to sell their property to black people...shameful.

Unbelievable. Thankfully, we can choose not to do business with whiners, too. They're not a protected class.

Fortunately, being "unable to qualify for a loan" is not yet a protected class . . . is it?

I just ran into a situation and was disgusted by her bigoted attitude.  I kindly removed myself from deal with her.  amazing how America seem to be separating and segrating itself on more than one level..

Sounds like the woman needs to take an ethics class when she renews her license.  In response to any comment I simple state, "I do not discriminate. You are either ready to buy or sell, so what is it going to be?" I have had them get up and walk away and my life was so much better.  The ones that stay know I will not tolerate that type of behavior.  This issue is not negotiable.

It is really  ashame that in this day and age, this country has not gotten past thing kind of thing, and many of  them are in Congress. As for me, I am white (tan in the summer) but being an alien, I saw how some people treated my father, who spoke with an acent. They thought he was dumb, and could take advantage of him. Little did they know and they found out the hard way.

Oh that is too funny. You just closed one with someone who was white and not a drug dealer. That must have been tough.

Wow.  I agree with you. A bigot is the right word.  I am really concerned for those that have to interact with her in her profession. Sad to say they might not be getting the best care.    :-(
