In the pursuit of a result, whether it be personal or professional in nature, everyone wants what they bargained for, paid for, hoped for and discussed. No one likes to get stung, learning by loss or going to court for clarity when all you really have to do is diligence. Due diligence
DILIGENCE defined: A careful and persistent effort involving concentration, care and thoroughness to achieve a result as represented or intended.
PERSONAL DILIGENCE
When getting to know someone either for a friend, date, neighbor or business partner, we are practicing the concept of diligence but in its informal phase. Nevertheless, it remains potent even watered down. Time & contact reveal much & allow us to personally risk (or not) comfortably as we go
PROFESSIONAL DILIGENCE
When we are conducting ourselves in a business or formal arena where there are major material considerations and risks, the process becomes more mathematical, practical and subject to analysis and reviews for our potential to gain or lose. Diligence is summoned and put to work liberally
DISCLOSURE
In Real Estate, I have a practice of making sure I reveal as much as I can called disclosure asked for or not. I do not wait but volunteer, reveal and/or point-out what there is or is not to be known especially a material fact. I take the initiative & the duty & share diligence liberally. But I go a step further than that
SUBJECT TO...
Everything I reveal is subject to the buyer and their agent verifying to their own satisfaction every and all things necessary for them to move forward on. In other words DUE DILIGENCE is upon them and subject to their acceptance or rejection. I make no representations to comply or accept but investigate.
BLAME?
Having spent decades in the courtrooms, the layman is quick to account how they didn't know, were mislead or misinformed & blame was the tool (& most common defense) necessary to seek recovery & damages. But over time, it was found that blame alone cannot make the case nor win over judges & juries anymore
BUYER BEWARE TAKES CENTER STAGE
Caveat emptor or let the buyer beware went to work. Who in their right mind buys a home sight unseen or on the word of someone else? Makes a large investment? Trusts anyone right away? Spends large amounts of money without hesitation? Doesn't ask some sort of question or make an inquiry?
ACT NOW BEFORE ITS TOO LATE?
It is further interesting to note that doing anything under pressure, coercion or an act of deception causes the "diligence" to suffer and become less effective snaring many into a affirmative action that directly interferes with diligence. Anything that works against diligence is a red flag we can all agree
SAFER TO PROCEED
If we all lived in a close-knit community, with ties & common interests and ran into each other every day, diligence would be less important because knowing each other & practicing trust & consistency is live diligence or living the diligence.We are already personal and in contact with all things known
THE BARGAIN
In the vast sea of cities, counties & states filled with people we don't know, we must summon diligence and let it go to work. Even better, having an agent or counselor involved only enhances the dynamic. Remember: people only want what is represented and if successful, the act is concluded & all prosper
MOVE WITH PURPOSE
I have often used the words "take your time" with people in many different situations especially when it comes to spending money or wanting to get ahead by going a head. If it is a situation where many are involved, I add the factor of please be advised that others are interested too. Still your diligence though!
RESEARCH & DISCOVERY
Emotions, state of the art marketing and advertising are all at work when we are out and about wanting something. That's why it is important to include a third party and to use time wisely before the act and not during it. Research provides for many a heads up before we enter into the diligence mode
Diligence came into existence because without it, random people suffered and lost considerably. With diligence in place, more good can surface and much good can prevail. Be diligent!
