A lot of Realtors offer home warranties to their clients,  But many may not know that the credibilty of the home warranty industry is tarnished in the eye of the public.  And for GOOD REASON.  The whole business model is intentionally flawed in their favor. But first, do a little research......

DO A BACKGROUND CHECK

I challenge anyone to  Google any home warranty company's name and the word `complaints', rip-off or `fraud'.  Find out how many people believe they got burned, turned down wrongfully or got rotten service..... here's one site that should keep you busy: http://www.my3cents.com/.  THERE ARE MANY OTHERS.....

CREDIBILITY GAP

There is a HUGE problem in the home warranty industry, and the public is becoming savvy to it.  But the days of an ignorant public being preyed upon by an industry lacking integrity is nearing an end.  Information is just a click away.

WHY SO MANY UNFAIR DENIALS ?

The problem is INHERENT TO THE MODEL on which MOST home warranties operate.    Here's why: 

THE NO-DOC HOME WARRANTY and the PRE-EXISTING CONDITIONS  clause

If you (as a homeowner) call up a home warranty company, and ask them how they can warranty a house they have never seen, they glibly tell you they take your word for it

But here's the sad truth : They do not want documentation ! That would eliminate the loopholes !

How many health insurance companies will insure you without a physical exam ? 

The fact is, most home warranty companies do not ask for or even accept documentation as to the serviceability of anyone's home, which creates a HUGE LOOPHOLE allowing the warranty company the option of rejecting the claim based on the convenient  ' PRE-EXISTING CONDITONS' clause.

The naive homeowner tells them his house and all its systems are in good operating condition. The homeowner is told his/her word is all that is required, but when it is time to file a claim will find it is his word against the home warranty's service technician.

The homeowner will ALWAYS lose if the technician finds a 'pre-existing conditon'  or other unexpected situation, because the warranty company always goes with the word of their technician!

KEEPING IT CONVENIENTLY VAGUE

Some home warranty companies even boast that an inspection is not required !  But that is exactly what should be required to establish the condition of the home and its systems and to eliminate the excuse of the 'pre-existing conditions clause.

Documentation would show that there were no pre-existing conditions, there were no improperly installed or sized systems.   But the warranty companies don't want documentation.  That would eliminate the opportunity to take your money and later deny your claim !

WHO GETS HURT IN THE LONG RUN ?

Obviously the homeowner is the victim.  However, Realtors who  sell them the rotten warranty product will loose a future referral.  To be fair however, there has not been an alternative home warranty product available until now.

On top of it the charge you the $50 to come out and tell you that you are denied, there is only one company that I've heard of that doesn't charge the $50 to come out.

Todd, as I understand it all home warranty's have a service charge for calling a technician out. I am not aware of any that don't. 

To me, the real issue is having a legitimate claim denied. Thats where our company's unique approach comes into play.

Eventually we will expand across the country.  I hope you will try us when we do get to Oregon !

I often go to bat for my Clients in fighting an insurance company's denial of claim.

One thing I always tell my Clients is that insurance companies are in the business of making money. They don't do that by paying claims. And if one has ever worked in insurance, one knows that the first line of defense is to deny a claim, regardless of whether or not the claim has merit. One needs to review the warranty carefully, as the insurance company accepted the warranted items condition when the insurance company accepted the premium payment. Had the insurance company done an independent inspection, the insurance company would have then had the opportunity to deny coverage, return the premium, and not issue the policy. The insurance company did not do that, therefore, the insurance company accepted the condition as warrantable and issued the coverage.

The reason why insurance companies deny claims is twofold: (1) they hope the homeowner will give in and accept their rejection of the claim; and (2) they think that your cost to get an attorney to fight them will be more than the cost to just go ahead and pay for the replacement yourself.

My most successful "at bat" was when I spent an hour on the phone with the Client's insurance company and then sat down and wrote a letter to the insurance company and sent a copy of the letter to the California Commissioner of Insurance. I sent the letter's by overnight delivery. Two days later, also by overnight delivery, my Client called. She was crying heavily and I just knew her house and slid down the hill from a disastrous plumbing leak. Instead, she was crying tears of joy because the insurance company had sent her a check for $11,950. It would have been $12,000, but her deductible was $50. She sent me a nice thank-you note and a gift card to Borders Books and Music.

'Twas very satisfying.

This is great info!  I typed in home warranty info on Active Rain and found your blog. I just needed a little bit more info on home warranty companies.  One of my clients asked me a questions about home warranties yesterday and I decided to try and learn a little bit more about them.  I know your post is 2 years old, however, thanks for posting and exposing the dirty secrets of the home warranty industry.
