I had a strange call from another Real Estate agent the other day. He said, "I see you have such and such address listed as PS (pending sale)".  I said, "Yes, You are correct, I do."  He said, "Did you steal my customer, you know there is so much of that going on these days."  I said, "Why, no, I didn't steal your customer."  I said, Why, who is YOUR customer?"  He said, "John Doe."  I said, "Well, I don't know John Doe, and as a matter of fact my customer is a woman and she is from XYZ state, not a local."  He says to me, "Well, John Doe has been trying to buy that property for month's now and to no avail."  I said, "I'm sorry."  I'm THINKING (not asking) what did you all offer?  My customer offered 3% less than the asking price, was no longer listed (I did relist it first.) and the offer was accepted. Sorry I said, I don't have any need to "steal anyone elses customer's".

Are you KIDDING ME? This was a strange phone call.

#1. Did you ever receive a phone call like this?

#2. How would you respond?

#3. If this agent is so good, why didn't he negotiate the deal for a good outcome for his customer?

#4. If he couldn't negotiate the deal, perhaps the offer was unreasonable, yes/no?

#5. If his customer [HAD] contacted me, is that stealing?

#6. Do I have to tell him my customer was not his customer? Do I have to tell him anything? or should I have just politely said he must be confused?

#7. What would you have said?

You know I think I have received all sort of calls like this, but none exactly like this.  Doesn't amaze you that people are just cooky sometimes.

Sounds like you handled it well. If it wasn't the same customer- no worries. If it was the same customer, simply ask for a his broker to send a copy of the buyers agreement to your broker.  I always refer these types of incidents to my broker .  Broker to Broker - I would hope they could work it out in an ethical and legal way without the emotional baggage.

This was my first like this!  I have to say, I was kind of shocked...this property was for sale for about a year, however it is rented and the owner is not going to go lower in his price, it has already been reduced by 100K and the price is right! Thank's for posting.

It was not the same customer, his customer was male, mine female. No big deal, the seller accepted our reasonable offer and it's all good!

We agents / Realtors® can become very paranoid at times. In good markets and bad, it is easy to start to think that someone else may be "courting" "our" prospect! Just like any other business or profession, there IS competition! It is my understanding that NOBODY "owns" a prospect; even IF there is a buyers agent agreement in place. I've heard it said that NOBAODY can take away your honor, unless it is freely given...

Karen - Unless the other agent has a buyer agent agreement with the customer, everything is fair game.  I find buyers now go from agent to agent.  Very few show loyalty anymore.  You did not steal a client.

I would refer to my broker.  I think the agent was way out of line to just come right out and ask you if you stole his customer.  Anyone who questions my integrity is going to be in for a shock when they get my response.  It will be professional but there will be no question when I say what I have to say about my integrity and the mis-guided nut who questions it.

Of course I didn't steal a customer, it WASN'T THE SAME PERSON.... My buyer is a woman, his buyer was a man. Not even close in names and it amazed me he called.

Exactly, I mean, I told him he was way off base calling me and that if he couldn't facilitate the deal, that's his problem and I'm happy I was able to facilitate the deal for my customer..."Tongue in cheek" - sorry for his luck, guess he should have counselled his customer into a more realistic offer!

You know the area, I'm in Ft. Lauderdale and those surrounding area's.  I know your area's as I used to work in Aventura!  You are right in your statement.  A buyer can work with whomever they choose.  It's their decision even if there is an agreement signed....

Unfortunately, I think the market is making some agents crazy. I think you handled it correctly although I don't know that I would have tolerated his line of accusing questions.

Karen- Nobody owns a customer.  Even IF he actually had a buyers agreement signed with your buyer, that doesn't prevent YOU from selling that person the home.  The agreement is between them and they would have to handle it, it would have nothing to do with you!  And you don't owe another agent who is not part of the transaction, an answer about your deal, next time tell him it's none of his business.  He'll never call again!  All the best!

Karen, I come across this about two or three times a year. I often reply, "Did your client sign an exclusive buyer agency agreement?" Inevitably the answer is "No" and then I'm stuck with the prospect of educating my competition.

I would have told him that he's barking up the wrong tree. It's not your fault if his "customer" seeks service elsewhere. I guess his service was not up to par. Glad to see you back and that you had a good week with your dad.

Great part of this whole conversation was that it wasn't even the same customer.  His was a man and my purchaser is a woman.  So after him stressing out thinking I took his customer, he only found out that it was a different person.

He was barking up the wrong tree...I think he felt like a squished bug when I was done telling him that another customer indeed purchased the townhome his customer had been trying to buy for a LONG time...

I'm still in PA, Dad's doing as well as can be expected. Then again, he didn't expect me to make him go for short walk's, go up and down the steps once a day for exercise and eat my cooking!!! LOL...I think he gained 10 pounds since I got here.  I'm going home Tuesday for a week to 10 day's to train my new assistant, then I'm coming back up in a week to 10 days. It's their 58th wedding anniversary 5/20, so if all is well I'm going to have a small party for them. 

And thanks, I was having AR withdrawl and just last night was the first time I had a chance to turn on the lap top!

He probably did need Negotiating 101 again, after all if he had negotiated the deal better his customer would have purchased the property and wouldn't have been available for my customer.  The listing had expired a month prior to me contacting the owner. The listing agent didn't renew it, so I listed it and sold it.
