"We had 7 offers returned for best. One was selected and approved Friday at 6pm."

Found this out on Sunday at 3:00 pm.

Showed the house Saturday morning at 11:00 am after Monika called to set up an appointment. I wrote the offer later in the day. Called the listing agent's office and got disconnected 3 times looking for information and the required disclosures and addendum's.  Person answering the phone finally said she would leave a message for the listing agent and they would get me what I needed. 

Never heard a thing and I finally emailed the listing agent Sunday morning letting them know I had an offer for them.

Met the buyer Sunday morning to collect the check, talked with the lender to get an updated per-approval. Monika called the listing agent, left a message, called her office left another message. 

Monika called again for the third time and the person answering the phone said the "listing agent will call you back if she wants to" IF SHE WANTS TO.

DejectedWHAT!!!!

We called her office again about the offer and asked her how she would like me to deliver the paperwork. This is her response...

"We had 7 offers returned for best. One was selected and approved Friday at 6pm."

Friday at 6pm....WHAT !!!!

Time invested... 3 hours

Buyers time invested... 4 hours 

Happen to luck out and get a an Unprofessional Listing Agent...priceless

Here in SW Florida we seem to have an increasing number of part-time agents who consider real estate to be their "sideline".  Just this week I had a list of 9 homes to line up for a showing itinerary.  (I know, you should only show 3 homes, but these are REOs, full of surprises).  Of the 9 homes, I was only able to get the lock-box combo for 5, starting at 4pm Friday and working most of Saturday morning.  What are these listing agents thinking?  And don't get me started on the cheap little combo locks they use.

A little discussion broker to broker should be in order on this one.  It is unprofessional and inconsiderate to say the least.  Updating the MLS is not rocket science.

I wish there was a decent way to weed out those agents!   Can't count the number of times I try to set up showings to hear they already have an accepted offer yet days will continue to go by without any status change showing up on the MLS....

Sad part is she is a broker owner and has been around a while. I knew we were in for it when I saw who had the listing. It certainly is a shame.

Oh, I hate t o read things like this Jay, it is my biggest complaint about Realtors. The MLS is for us, so why don't agents give us the TRUE facts. There are certain companies in Ann Arbor that are notorious for doing it so we will NOT show unless we  call them.

Jay I wonder how Realtors like this would react if the table was turned on them.  If I was a Realtor and saw this Realtor's name on a listing again I would just keep on moving to the next one.  Sooner or later they might get the message.

That really is terrible, makes me wonder how they got the listing to begin with.   There really is no excuse to be rude, (at least that's what my mother told me while I was growing up.)

We've all gone through this.  It always seems to happen on the weekends. 

The listing agent was simply totally inconsiderate and unprofessinal.  Once they had a contract accepted, there should have been a notice made to the showing service that only BU were being accepted.  This is an agent who just doesn't care.

Unfortunately,  there isn't much that can be done about it.  Agent policy comes down from broker policy.  Probably no help there either. 

It's unfortunate, we really have to check personally with each listing agent to verify fully avaibile listings.

Jay - Congratulations on the feature! I had the exact same scenario last weekend for a buyer. Was your property bank owned? Mine too. I to date have not even had my cash offer faxed over the weekend acknowledged that it got presented to the bank. Something needs to change. I wonder if the banks know how their property offers are being handled. To say the least the agents are overwhelmed with too many listings. Maybe it's time for them to think about spreading the listings around.

We are seeing this lack of professionalism at the Seacoast as well.  Was this a bank-owned?  We are seeing this type of behavior more prevalently in that market.  It seems that if an agency is too busy that they should either hire more folks to cover the work load or turn down the business.  Well, I sure hope that your buyers find something that they like even better.  Good luck.

That does sound like a bank-owned.  EXTREMELY frustrating!  And what is with these foreclosure listing agents?  They are usually not cooperative at all (not just because of their clients).  I had a client interested in a foreclosure property and there was a sign on the door of the property saying "This property is not yet listed. Please call xxx-xxx-xxxx for more information.  Anyone found going into the property will be prosecuted."  So, even though there was an MLS box on the door, we did not go in.  Called on the property the next day (it was Sunday when we were looking), turns out the property has already been SOLD!!!  I was thinking - "well how about taking those ridiculous signs down then!"  Unbelievable!

How unprofessional to at least not return one of the phone calls!  I try my best to talk to an agent who calls about a listing under contract asap so they are not wasting their time or their buyer's time!  I live in a town with an Air Force Base.  All it takes is someone to go back to the base and say the listing agent was so and so and they didn't respond to phone calls or emails and your reputation is tarnished for a long time.

Quite normal in my area. It certainly sounds like bad timing all the way around. I'm pretty sure I would not place a property pending in the system at 6:00 on a Friday either. Our MLS gives us 48 hours and chances are I would still be waiting for complete paper work. BUT you ceratinly would have been able to reach me by phone. Very unfortunate for the buyer.

Jay, I had this happen to me too. I was showing a house on a Monday. My buyers wanted this house. It was still showing as active and the message I left for the listing agent hadn't been returned yet. So they were ready to write up an offer. I called again, no response so I left a message that I was sending over an offer. Still nothing. We go ahead and submit the offer. My buyer and I decide to go to lunch, I get a call on the way there from the listing agent's assistant. She tells me that they already took highest and best on Friday. I asked, "so the property is pending?". She says no, "technicaly it is still active". So I say "So then will my buyers offer be presented as well?". She said "I don't think so but I'll put it on his desk". Great, so we move on to the next favorite lsiting.

But it gets better, Fast forward to Wednesday - 5 days after they received 'highest and best'. I am talking to my boyfriend, also an agent at my co, who is telling me about properties he just showed to some customers. Yep, he showed that house too - WHY is this house still active???

I note that some responses here have a problem with the property remaining active when the bank has accepted an offer but has not signed any paperwork.

When I get offers that results in the bank calling for highest and best I notify the agents of the bank's position. I also tell them that the bank will continue to negotiate offers and it retains the right to choose another offer at any stage of the process.

When I have the highest and best and the bank has notified me that it has chosen one, I cannot, under the terms of the MRIS MLS agreement, put the property as under contract as I do not yet have a signed contract. I get a counter offer back from the bank detailing what they will and will not accept as terms superceding the Northern Virginia contract we use. They give the buyer 5 days to complete any inspections before signing the addendum and getting it back to me. At that point I have a contract with an addendum signed by the buyers but not the bank so still not a ratified contract. When the bank finally signs off a week or two later then I have a ratified contract and can update the MLS.

The best way I have of meeting the requirements of the MLS while keeping agents in the loop is to place verbiage in the comments section notifying agents that the bank has accepted an offer while leaving the listing as active.

It still doesn't avoid issues with agents failing to read the comments and I do try and answer my phone during reasonable hours to deal with questions.

I would be FURIOUS...as you seem to be, lol...rightly so. How ridiculous!  Time to "get rid of the unprofessional agents".  The next house you find for you buyer will be the right one. I'm a firm believer in all things happen for a reason. (except wasting your time with that agent).  Makes you want to steer clear of doing business with her in the future, I"m sure! That's what some agents just don't get.  Do unto others!

Jay -- what is there about the word "cooperate" some of these agents just don't get!  I am the ethics chair for GMNBR and I am getting a lot of calls about Realtors(r) acting BADLY!  I hope this doesn't continue.  Things are challenging enough.

Thank you everyone for your comments. I agree that the agency has 24 hours to report the sale to the MLS and I have no problem with that. I know now that the bank signed Friday night.

I think getting hung up on 3 times and not hearing from the agent at all and the comment "She'll call you back if she wants too" was a little hard to swallow.

I know we all get busy but sometimes a quick little phone call can go a long way. I am a firm believer in what goes around comes around.

We have another contract in on another bank owned. This agent so far answers her cell phone and has been very accomodating. A true professional.

This kind of stuff is happening more and more in our area.  Its so frustrating to spend so much time with clients get their hopes up and then to find out that another offer was accepted even before their offer was presented.  We have all been there.  Part of the issue is that even though a verbal acceptance is made it takes sometimes a week to get the ratified contract back from the bank.  And with the banks that I work with I must have all the signatures before I can mark it as UNder Contract.  However if someone was to call I ALWAYS make sure I get back to them as soon as possible

this used to happen to us until around two years ago....On our MLS Board, we have to present a multi-offer disclosure form where everyone has an option to bid up or better until a cut off day (usually 48 hours) and all agents involved have to get the fax notifications signed by their buyers. at least it lets the buyers and agents know what they are up against. might want to petition your board for a policy change.

This can be very frusterating.  Sometimes, you must simply believe that there is something better out there for your buyer...I've found that a lot of times, this is actually the case & a disappointment turns out to be something good. Hope all turns out well for you& your client.

I set up an appointment one time to show a home and was on the way with my client  when I got a phone call from the listing agent saying the home was not available for showing. When I asked why, he said because the closing was the next day.  His office had failed to change the status of the home for almost 30 days, nor notify the showing schedule company. I let the MLS know about his lack to update the status of the home, which is a three day rule requirment.

sounds like the other offers were already at the bank - and until there is an answer you have to leave it open - however the sales I have dealt with like this when your offer came in would start the highest and best all over again.... sounds like the agent and the office may have been a little overwhelmed and unprepared

Welcome home to the Las Vegas REO market!  Multiple offers and DO NOT expect a response from the agent!  I had one hellish experience back in January where I wrote an offer on a property after calling the assistant who said there were multiple offers but no bank acceptance.  Got the offer in to them within a couple of hours.  I got a call from the listing agent asking me why I would waste my time doing this on something with AN ACCEPTED OFFER FOR A WEEK.  Status wasn't changed in the MLS, this was active!!People who insult my intelligence will be remembered in the future ARGH!
