Is it LEGAL for a home Seller to accept an offer the 1st day

Is it legal for a Seller accept an offer without even responding to any other offers submitted? That was a question by a Manchester NH area Home Buyer whose offer was not accepted.  What the Buyer did not realize, is there is no law that a home owner has to respond to all offers before accepting one. The law does state the listing agent has to submit all offer to the seller, but there is no law on which offer or in what order they can accept one.

 

In most cases if multiple offers, a seller will then ask for every buyer to put in their highest and best offer. However they are not required, it does happen that one of the offers is perfect. The owner can than choose to accept what they want after going over the pros and cons of all of them. Highest price is not always the best if an offer is loaded with contingencies.

 

The key for Home buyers is to ask if there is any offers already submitted. They can then revise their offer and make their highest and best offer now without being asked.

 

The key for home sellers is to have already discussed what is and what is not acceptable. That way when an offer does come in, they can make a decision promptly on what they will accept or counter those that do not. 

 

In conclusion, the agent you hire should look out for your best interest. BEFORE hiring an agent, You should know that the BEST way to go about any home sale or purchase is to know that the consumer should not choose just any agent, choose the BEST agent for the job. Hello Scott, It is up to the seller to if they want to book at all the offers or ask for just the top offer.  We are the ones that should advise that to look at everything but they do not have to.

Most buyers in this market here know to put their highest and best first as there is often many offers the first couple of days n my new listings .  The one sthat dont were the ones their agents never told them to

It only takes one offer to make a seller happy.  If it comes on the first day, that's awesome.  Of course, if the seller would continue to have the house in tip top shape for longer and take a chance on getting that same offer or better later, that's their call.  I rarely find they will opt for continuining to market if they got an offer they like.

Sellers can always choose to accept, reject or counter any offer received.  But they can also ignore.  This last is very frustrating for a buyer, and his/her agent, but a seller is under no obligation to respond if he/she doesn't want to. A good listing agent will keep all parties informed about what is going on, however, and let the agent know that the seller is not responding to his/her client's offer.

The bottom line is it is the seller's house and he can take any offer he wants. I once had a buyer threaten to sue me because my seller didn't take his offer. He was a professor at the university and should have known better.

Lynnea Miller in this case there was several offers, the seller chose an offer just over asking price with no inspection and a pre approved buyer who submitted a pre approval letter. They didnt want to risk losing a great offer by countering any other. The buyer who balked made a low ball offer, how can they be taken serious in this market?

I like to prepare the seller for teh whole selling process, from pricing to getting the home ready for showings to getting offers. I do wrn them we can get offers teh first day and make sure they are prepared for it Chris Ann Cleland  .
