MAY I KICK THE TENANT OUT MYSELF FOR NOT PAYING RENT PHOENIX PROPERTY MANAGEMENT

 

phoenix property managementIt was just another day in Phoenix Property Management in 2017. I received a call from an investor who was a referral from another agent describing his situation. He informed me that the current tenant has not paid rent and believes the utilities are off. His first question to me see below:

 

"MAY I KICK OUT THE TENANT MYSELF FOR NOT PAYING RENT?"

 

I am sure every investor who manages their own property is thinking the same thing. However, we must follow the Arizona Landlord/Tenant Act when it comes to people not paying rent. I explained the following steps HOW TO PROPERLY EVICT A TENANT IN ARIZONA see below

 

  • Deliver 5 day notice either in person or certified mail or both
  • Start eviction process on tenant failure to pay rent when time is up
  • Obtain judgment on the tenant
  • Judge normally gives tenant 5 business days to move out of unit

 

WHAT IF THEY DO NOT MOVE OUT BY AGREED COURT DATE?

 

This was a great question by the investor. I explained to him we would need to order a writ of restitution. This allows us to change the locks and remove all people from the unit with the assistance of the local constable for that area. We now have full control of the unit legally so we can get the unit rent ready to place a new tenant that pays rent.

 

Finally, the investor would like to discuss property management after we remove the tenant from the unit. Is it time to be part of something bigger than oneself? We are here to assist all investors when it comes to Phoenix Property Management.

Good morning Harry.  Our are similar except we have what is called a Writ of Execution.  Once the order is signed by a Judge they send a Deputy Sheriff to the home.  The Deputy usually gives the tenant 5 hours to come up with the money.  If they don't the Deputy calls a moving van and physically moves all the furniture etc out of the place.  Posts a notice on the door and should they return they are arrested and placed in jail.

James Dray here constable removes the tenants from the unit and we change locks to secure the units. Tenant will need to make arrangements to pick up their personal items.
