What Does Selling a Home As-Is Mean to the Buyers and Sellers?

I met with a first time home buyer today after speaking with her on the phone a few times. Although she never purchased a home before, she is a savvy buyer thanks to the internet and all the information and different opinions.

During my buyer consult, I go over the FL Residential Sale and Purchase contracts. One is an AS-IS contract, the other is not. Within the past year, more and more listings get listed AS-IS in our local Multiple Listing System.

What does AS-IS mean? Should home buyers still get a home inspection?

As a home buyer, whether the home is being sold AS-IS or not, it is within your best interest to get a home inspection. Based on the results of the inspection report, you as a buyer will make the decision of either moving forward with the purchase or withdrawing your offer based on the inspection.
Home sellers should still complete a Seller’s Disclosure. If there’s a known defect, it should be disclosed. Based on the type of listing (AS-IS), sellers have indicated that they make no warranties.

If you are a home buyer, be sure to find a local REALTOR® who knows the area, local real estate market, someone you like and trust. With the help of the internet, you will be able to complete this task in a short amount of time.

Should buyers contact the listing agents directly? Listing agents are hired by the sellers and they represent the homeowners. It would be a good idea for you as a buyer to be represented by your own REALTOR®. Your agent then will lead you through the right path during the entire transaction. Finding your dream home is the first step, there are many steps between the contract to closing that are best handled by professionals who do this on a daily basis. Recommending a reputable, licensed & insured Home Inspector is the first step after contract which should be done in a timely manner or you might risk losing your escrow deposit.

As a real estate agent, I treat AS-IS listings same as the others and always recommend a home inspection after reviewing the Seller’s Disclosure. Don’t let that scare you, the home may be in perfect condition but only a home inspector would be able to tell you that.

Ginger Harper this is a good article for a reblog. I personally tell clients to get an inspection. Just because it says "as is" doesn't mean they won't negotiate.
