MAY I STAY ANOTHER WEEK AFTER EVICTION COURT PHOENIX PROPERTY MANAGEMENT

 

PHOENIX PROPERTY MANAGEMENTIt was just another day in Phoenix Property Management. Many real estate agents avoid Phoenix Property Management like a bad disease because of horror stories. Yes, I have seen it all since I have been in Phoenix Property Management. I have a simple philosophy when it comes to Phoenix Property Management see below:

 

PAY OR PACK!

 

I was attempting to contact a recent tenant who lost in court for failure to pay rent. The court system gives tenant 5 days to remove themselves from the unit. If they do not remove themselves in 5 days, then the owner has the right to writ of restitution in which we get the local constable involved to remove the tenants professionally while we change the locks to take back possession of property.

 

So, the tenant texts me back asking me the following question

 

MAY I STAY ANOTHER WEEK

 

I informed the tenant that the judge gave them 5 business days so I need them to comply to the law. The tenant texts me back saying they will be out. What they say and do are two different things from my experience. There is a 50-50 chance that they will move out on that time. So, we order the writ of restitution to remove the tenants so we can make unit rent ready to place another PAYING tenant so the owner receives cash-flow.

I handled rentals for a few years when I first got into real estate - and can't say I enjoyed it! We only had to go to court once to get a tenant out, but sure had other issues that were no fun.

Harry- we had tenants once and that was enough for Larry.  Many were excellent but we came very close to have to evict them.

Many delinquent tenants know how far they can push and leave on the day before the eviction. Words spreads fast and they are one step ahead.

Harry F. D'Elia - you have a tough job. I don't envy you. Once the judge rules and gives an order, there's nothing you can do but to obey the law yourself. I'm sure you have been through this rodeo many times and as a true professional you are doing your job without bending the rules.

I like the quickness in your system Harry F. D'Elia. Here, If after 7 days they have not paid, we can give them a 7 day notice to quit, (pay or move) if they do not move, we can file for a hearing (usually takes 2 weeks) then the judge will ask the landlord and tenant to try to make a deal or he will issue a firm date for the tenant to be out, normally 7 days. If the tenant is not out, then we can petition the sheriff for removal, but can take 2 -7 days

That is a very quick restitution system, pay or move out. Sometimes as agents we need to be focused on who we represent or else we can get side tracked by the excuses and sob stories. The court ruling is a wonderful thing to be able to point to for us.

Great post on why owners should use a property management company.  Many owners feel bad evicting tenants and can be taken advantage of by the tenant.  A good property manager is a must!
