You're putting your house on the market and filling out the Seller's Property Disclosure that will be given to prospective Buyers. Which items are important for you to disclose?

> You had a plumbing leak fixed last year so you don't need to disclose that, right?

> You have an old electric box that caused a fire a few months ago, but all the damage has been corrected and you've put in new breakers. Why do you need to tell anyone if it's already been rebuilt?

> You put in a new back patio that made the basement flood when it rained and caused thousands of dollars worth of damage. But you put in gutter extensions and had the damage repaired, so why should you mention that if it's been fixed?

> A neighborhood child accidentally died in your back yard. In Colorado, that's considered a Psychological Defect and can't legally be disclosed without the Seller's permission. You don't want anyone to know, so you're not going to divulge that piece of information. (Same principle if there has been a suicide or a murder that's taken place on the property.)

If anything similar has happened to you, you might want to think twice about how you proceed. When in doubt, DISCLOSE, DISCLOSE, DISCLOSE.

When you tell them upfront, Buyers are usually reasonable about previous problems that have been taken care of. It's being caught off-guard afterward when nothing has been previously mentioned that tends to make them feel ambushed, and often has them tracking down a lawyer. You'd be surprised how many times the new Buyer calls the same plumber/electrician that you used. And many people don't care, but there are others who won't live in a suicide house.

Play it safe. Disclose up front and don't run the risk of the excited neighbor spilling your beans to your detriment, because trust me, they will.

Great picture and post!  Honesty is the best policy I tell people.  In a hot sellers market, it generally will not stop the home from selling anyway.  In one that is slower, price can usually "fix" it for the buyer and leave the seller not looking over their shoulder.

Neighbors are always willing to put in their two cents. We moved into a resale home many years ago and the home we sold had a wood stove. The new home didn't have a wood stove or fireplace but we were going to have one put in.   So moving to the new home we took our firewood with us. As we were throwing the firewood off the truck the across the street neighbor came running across and asked "you know that house doesn't have a fireplace right?" Guess she thought the seller hadn't disclosed that little fact that didn't really need disclosed unless you were REALLY sight impaired. It's the little things in life that make the world go round!

When I was growing up my dad was in the upholstery and furniture repair refinishing business. He came home one day to say he had a funny call from a lady that wanted a round table 36" x 36" refinished. Yup.....here's your sign!

I recently had a discussion with fellow agents regarding disclosing that a home had been remediated for defective drywall.  I believe 110% that is should absolutely be disclosed and was shocked at some agents thinking it didn't need to be since the problem was "fixed".  I am a big believer in disclose, disclose, disclose!!

When we were looking for a home in the school district we desired ~ I was actually on the look out for Nosy Neighbors.  Loved the idea of extra eyes on what goes on in the neighborhood.  And you are right Mimi Foster ~ they will "disclose" information about the previous owner.  They keep track of how many times you call a plumber, electrician, etc...

I agree with you. HOwever, sellers have to take care and complete the disclosure completely!  So many do not do that. Another pet peeve is if they refer to attachments...and there are none!

Very true!  Because if the Seller's don't disclose and then the Buyer's find out something they already should know, life is a lot rougher than disclosing in the first place!  I say - overdisclose!!!!

So true!

I always share two tips with my buyer:

  1. The permits you don't pull will rarely be caught by the city, but almost always narced out by your neighbors.
  2. Want to know what it's really like here in this neighborhood, don't ask the owner, ask their neighbors. Pop-by the neighborhood on the weekend or evenings and catch neighbors in their yards and strike up a conversation.

Last November we busted a seller for not disclosing chimney issues because a neighbor was talking to my buyer and I after the showing and mentioned how the seller can't use their fireplace anymore due to a cracked firebox. Not in the TDS and hidden by candles in the firebox, but we tagged them for it by doing a chimney inspection.

The retired neighbor couple across the street bought their home brand new in 1970. They raised their family and now the grandkids come to visit them. They know the history of the neighborhood since day 1.

I love stories like that, Jerry Lucas. I bought a 1951 house in Cheyenne Canyon in the summer of 2015 from a 94-year-old couple. They had lived here since 1970 and that was the last time the house had been updated. Even more fun was that her sister lived next door for 50 years, so there wasn't much we didn't find out about the neighbors and the area and the houses. Thanks for your comment.

Hey, Thomas J. Nelson, Realtor, CRS. Absolutely . . . if the City doesn't know, the neighbors certainly will. My Seller didn't disclose that since he put in the new patio that the basement floods if the gutter extensions aren't down. Easy disclosure, right? It cost him almost $10,000 when the neighbor came over and said, "Oh, that happens all the time. It's like a fish bowl in the window well if you don't put down the gutters." U.G.H.

Great post, love it! BTW, overdisclosure is my middle name ;)  Sometimes I'll go over and talk to neighbors if they're out and about while I'm inspecting.
