Does name on ID match name on document being notarized?

I recently had something like this come up at a loan signing where the name on the ID was slightly different than the name on the document.  It's important that other notaries are aware in case something like this comes up:

"NNA QUIZ QUESTION:

When filling out a signer's name on an acknowledgment certificate, the name should:

a. Be written to match how it appears on the ID presented to the Notary.

b. Be written as it appears on the signer's birth certificate.

c. Be left off the notarial wording if the signer requests privacy.

d. Match the signer's signature, but should not be written in the Notary's journal.

ANSWER: A) The name of the signer written in an acknowledgment wording should always match the way the name appears on the ID the signer presents to the Notary. Even if an "AKA" signature using two different forms of the signer's name is written on the document, only the version appearing on the ID should be included in the certificate wording."

Notaries should always be alert for minor discrepancies in the way a signer's name appears on IDs, documents or signatures.  If you're unsure, it's better not to proceed.

Hi Denise:  Nice to know about the details of signing.  Glad I am not the one to make sure it's correct.  Very nice background, certainly did not take you long to get it all figured out. :-)

I am not sure I understand the NNA question & correct answer on this situation and I am only writing about California Notary law?

If I am notarizing a Deed of Trust (ACK) and the loan signing documents (as an example) have Jason W Smith typed in as a name to sign; I am not going to put in the personally appeared section of the notarial certificate the name: Jason William Smith because that happens to be what is on his driver license or any acceptable I.D. used in CA.

As I said maybe I just don't get the question?  Help me out here.

Thanks

Hi Denise, what did the title company tell you to do?  Did they re-draw the docs?

Joan ~ You'd have to double check with the NNA, but it is also my understanding that you wouldn't put the entire name on the ID in the "personally appeared" portion of the notarial certicate.  I think what they mean is to make sure the name on the ID closely matches the name on the document being notarized.  I always use the "more (on the ID) is better than less" rule.  For example, if the ID states John William Smith, it would be ok to notarize a document with the pre-printed name of John W. Smith.

Lacy ~ The loan docs I notarized did not have to be re-drawn.

I agree Denise.

You can always  have more information on the I.D than is required on the document to be notarized, but it can't be the other way around.
