Risk Management: Fighting Against Real Estate Malpractice Course  Did you know that the Court set out the rules for implied agency over 20 years ago? That’s all about being an agent and not having any kind of paperwork to show for it. Most real estate agents never heard of the case. The decision goes into significant detail; it’s 104 pages in length.

The Supreme Court of Canada has dealt with Seller’s Disclosure, the Litigation System, Agency, Misrepresentations, as well as Liability and Negligence for agents.

On 13 November 2014, the Court changed the common law and established New Duties and Obligations under Contract, including honesty and good faith. This is a monumental change that effects how we will deal with every contract going forward.

This program considers those issues which are identified as the high risk areas for real estate agents, and considers safer, better business practices.

We look at the issue of informed consent, proper execution of the documents, various forms documenting “consent”.

We look at the concept of the contract start time as the measurement of various obligations. Get it wrong and you could be in trouble.

We also consider: 1) Lawyers’ Approval clauses and their usefulness, 2) Minor changes to agreements, 3) Adding and substituting parties, 4) Revocable Offers, 5) Title Insurance.

We will look at the new trend in real estate liability and changes from RECO.

And, don’t forget there is a morning program too.

Time: 1:30 pm to 4:30 pm 10 April 2017
