What would you say to a Home Buyer demanding the Listing agent give them the fee their buyer broker would have earned? This young couple is looking to buy on their own. They called on a new Manchester NH Area listing.
Something that seems to becoming more common is buyers who do not want to work with a buyer agent. These buyers said they read they could ask for the buyer agents commission by acting as their own buyer agent. There is no shortage of online advice, and this proves not all of it is good.
Before we dove into commissions, my leading question was had they been pre qualified for a mortgage and with who? They paused and eventually replied that they had pre qualified them selves using an online mortgage calculator. Unfortunately that is not what any listing agent or seller wants to hear. The first step was explaining disclosure. They did not wnt a buyer broker no way, no how. That was fine as this is my listing and i represent the seller. Here in NH I can be a transactional broker for any buyer. Mainly consists of answering questions, showing the home and writing an offer while not representing the buyer.
I went through some basic questions to see if these buyers were able to get a mortgage. Basic questions such as how long have you been employed, your income and expenses. From this step we called a local and trusted loan officer who was able to take it from there, pull a soft credit and give us a pre qual based on what they saw. There was though some questions and items the buyers needed though to show some loans paid, bank statements and tax return.
WHY did I offer to pre qual them if they want to do everything themselves? BECAUSE I work for the seller. My job is to sell my listing. These buyers are interested, but no way do we show to buyers who are not qualified to buy. It was worth every minute spent making sure they could buy, before showing them and writing an offer.
Fast forward a week and the buyer got what the loan officer needed. They again wanted to discuss paying them a commission. First, they are not licensed so they can not be paid a commission. Second, they have not even made an offer never mind have it accepted to be able to demand anything. They got quiet as reality set in. Third, commission is paid by the seller to the listing agent through a contract. The buyer can not dictate what is or is not in that contract. We finally got a clear from the loan officer and were off though to see my new listing.
They LOVED it. They wanted to make a verbal offer. I then sat down and explained how the offer process worked. That it needed to be in writing, accompanied by a deposit, that they had the right for an inspection and how the mortgage contingency worked. They understood and asked if i was writing the offer. They huddled with their parents and came back with a price to offer including 3% towards their closing costs. Later in the day i presented the offer to the seller. The seller countered the offer at full price and was ok with the 3% closing cost credit, ok with the 10 day home inspection and 30 day mortgage contingency.
Mr. Buyer would not let go of the thought of asking for a commission. He was loud, mean and unrealistic. He would not sign the sellers counter offer. Mrs. Buyer put the hammer down on him. He is not licensed therefore he can not be paid a buyer agent fee (per state law, period and amen). Mr. Buyer walked. Mrs Buyer cried. In the mean time we have quite a few showings on that home. Can you guess what the outcome will be?
THE SECRET OF SUCCESS and the key to having a successful purchase of sale, can increase simply by choosing a better agent. A buyer should have their own agent, one that will work for them through the entire buying process. A buyer broker gets paid a fee from the listing agent at closing. They can assist the buyer in negotiating what is best for them. This buyer in a haste for savings is costing themselves more money and stress for no reason.
The secret is, that All Agents are not created equal and every buyer or seller should take the time to hire the BEST not just the biggest.
