How to Remain Neighborly with "Good Neighbor" Fences

Most everywhere you go in California, you will see communities with fences running between homes. Usually they are 6' cedar or redwood, which provide a bit of illusion and some reality of privacy.

However, when the fence begins to age, and the winds come, the fence can come down.  Sometimes there are trees, and other issues that pop up with fences.  Since many of these fences are termed "good neighbor" fences, who is responsible for paying for replacement or repair?

According to California Civil Code 841, if the fence is on the property line, then both parties are responsible for the fence.

Should one party decide not to pay, there can sometimes be remedy in small claims court.  But doing so certainly won't enhance your relationship with your neighbor.

Insurance policies will sometimes cover loss due to windstorm or fire, but that amount is usually half the value of the entire fence, minus half your deductible.  That's assuming that the neighbor will be doing the same with his insurance carrier.

Kodi Bear was a beloved dog that lived with me for many years.  He was a very lucky pooch.  I say that, because he shared a "good neighbor" fence with Jack, the homeowner, who lives next door. 

I think both Jack and Kodi Bear will admit they weren't the best of neighbors in the beginning of their relationship.  Every time Jack would go out in his yard and approach the fence, Kodi Bear would bark relentlessly at him, from our side.  I am certain this drove Jack nuts, until the two of them worked on their communication skills.

It started with Jack, talking gently to Kodi Bear, and offering him treats. Anything food related worked really well as a bribe, for cozying up to Kodi Bear.  Over the years, things really blossomed between the two of them.
 

Evidence of their bromance came when Jack and his wife built an elaborate Koi pond with Japanese landscape.  They replaced a section of fence between our houses, and made certain they included a private window for Kodi Bear and Jack, so they could visit with each other at the fence.


However, not all "good neighbor" fences are as peaceful and delightfully handled as the one between Kodi Bear and Jack! The key is to take a lesson from Kodi Bear and Jack - "Good neighbors communicate."

Debbie Reynolds - Jack, the neighbor was actually a human visitor to Kodi Bear. However, Jack did have a couple of dogs that visited through the fence as well.

Loved your story of Kodi Bear and Jack, Myrl Jeffcoat.  I do have a 6 ft. cedar fence around three-quarters of my yard... on my lot and when strong hurricane winds come in, I am the one to cry.  But I love my fence and the privacy.... What I do not like is on one-quarter of my lot I have Honeysuckle bushes...true, I do love them, but not the work. Have about 50 mature bushes that need to be cut, hedged, trimmed throughout the year.  Costly  - time and money$$$$$ !! ;-(

Jane Chaulklin-Schott - I had a neighbor that was over run by Honeysuckle and Blackberry bushes.  A friend lent them a pair of goats that cleared that stuff out in no-time.

This is a beautiful story about Kodi Bear and the lessons he taught. Here in TX we have those same type of fences and I find it to be somewhat annoying, especially when they start to deteriorate. You offer great advice and Kodi Bear is a shining example of how effective communication and being nice makes perfect sense. I'm sure you miss him and have many great Kodi Bear stories. 

I live next door to a neighbor whose dogs never stops barking - especially between the hours of 1 - 6:30 a.m. I can appreciate a Kodi Bear who has good manners and makes a good neighbor with other pets and/or people. I love the idea of the doggie window! 

It would be great if your story got featured!

This is excellent information for home owners.  Barking neighbor dogs can be so annoying.  Sounds like these neighbors worked out a great plan.

Fences definitely lead to boundary line disputes and questions of responsibility when the fence is damaged.  Laws make it clear who is responsible, but you can't legislate the kindness you describe between Jack and Kodi Bear.

Where I live in Land Park, we handle things a bit differently. If a neighbor wants to replace the fence, a neighbor can do without involving the other neighbor and can have all the boards facing away from the neighbor's house. So the person who pays gets the nice side.

Nobody will ever make neighbors share the cost of a fence here; it's just not done. Don't get me started on fences, LOL.

No fences.. unless stone walls from picking rocks, throwing them along the boundary that last for years. To show and tell where the lines are. Less people mean no fences or using trees, nothing to replace that is wooden or needs repair Myrl Jeffcoat in Maine! Great post!
