Q & A - How Long will we pay for an HOA?

HOA - how long do they reside in a community?I was helping a potential buyer trying to decide what community they wanted to live and the question was posed -
    If a community has an HOA, does it stop in 20 years, or when does the HOA stop making rules for those homeowners?

 

GOOD QUESTION, and one I did not have an immediate answer for.  I found out they are permanently in place.

 

However, there is no blanket answer for all questions either, as it differs with every HOA and will spell it out in the governing documents.     You will find this information in the Declarations and is usually written by the builders or developers per development.     In these declarations it will also state how to modify or resolve any HOA issues.  The declarations is the Bible and prevails over bylaws or regulations.

 

However, this is not as easy as it sounds.    It will spell out the exact procedure to follow, but will take a 2/3 super majority to change anything in the declarations.   

 

In a detached housing community, the HOA is responsible for the watering of entries and common areas, perimeter fencing and trash collection with recycling.     In a multi-family complex (condos & townhomes) there are other items to include - clubhouse, pools, fitness facility, tennis courts, exterior building and roofing, insurance, water/sewer, trash and grounds maintenance.   Downtown lofts may have concierge services, hot tubs, grilling areas and fire pits.

 

Unless there is severe action taken by homeowners in a detached home community, you most likely will have a governing body (HOA) in a community permanently.

Since I started 5 subdivisions I knew they were permanently in place. It takes a lot of thought and planning to make the rules and make them fair.

Great article Joan Cox .  I sell a lot of common interest properties and they are not all equal.  I encourage all my buyers to really examine the HOA docs and make sure they understand what they are signing up for.

Jim Cheney I sell a lot of newer homes in HOA communities also, and they are not all equal.  Some are much more lenient, and sometimes you don't know until you move in, even with reading all the documents.  If there is concern, I like to have buyers chat with the neighbors to find out more information.

Hi Joan Cox 

The HOA in our neighborhood consists of 22 properties. It was established in 1954 when the owner subdivided the land. It contains rules about how high the fences can be and we can't build a boathouse and how we need to care for the 2 pieces of common land.

We have plenty of HOAs in our area and buyers often have strong feelings about them, both pro and con. Doing your due diligence, understanding how they work and the costs is essential before jumping in.

When I purchased my home, I didn't want to live anywhere where there was an HOA so when my realtor showed me the house that I eneded up buying it showed an HOA.  I was immediately turned off the property but mty realtor did a little digging because he was familiar with the subdivision and it was built in the early 70's and he had never had to deal with an HOA in any of his previous transactions in the same subdiviion.  Upon research we found that the HOA did not renew their charter after the initial 20 year term in the original governing documents and even though there were covenants still recorded there was no HOA to enforce them or collect dues. If my realtor had not gone the extra mile and researched this issue I would have lost out on my perfect house!!

Doug Dawes that is interesting to hear an HOA exists in a neighborhood built in the 50's.   We don't have that here.   Rules are good to keep the values up.

HOA fees? I believe it is a life term fee that never goes away, same as taxes and home insurance if you buy a unit in the community.
