Originally under County ordinance, a violation could be punished with a fine or a misdemeanor criminal charge. the ordinance now requires all first-time violators receives a written warning letter. Only on a second violation can the jurisdiction fine or charge the violating landlord.
Under the ordinance adopted by the Santa Clara Supervisors earlier 2017, every rental, including individually owned condo, single-family homes, and accessory dwelling units (e.g. grannie units) in un-incorporated area will be required to take a housing voucher as of January, 2018.
Single rooms rented out in owner-occupied houses are exempted. Advertising units as not accepting vouchers constitutes a violation.
Section 8 vouchers, on the other hand, require inspections for safety and sanitation issues, lengthy time delays, repairs, as well as comprehensive reports.
Though Section 8 is in Santa Clara County, Northern CA is mandatory. If two equally qualified applicants ( references, rental history, credit checks, and whatever other requirements the landlord places on the tenant), and the one with the Section 8 voucher applies earlier, then section 8 tenants must be granted.
Again, started in January 2018, it is illegal to advertise "No section 8 vouchers honored". Those who do are in violation and can face fines or misdemeanor charges.
