Who is to blame when the Home Inspection FAILS?

The phone rings, it is a buyer, but wait, not one of my buyers and not on a call on one of my listings. The buyer had a home inspection, it failed... now what do they do?  This was a question asked by a caller who saw my Active Rain Blog

 

This buyer does not have a buyer agent. The home is a FSBO, meaning the seller is selling themselves. The buyer is stuck. The seller is stuck....now what?

 

For the buyer, a lesson in why they should have hired a good buyer agent who would be standing by them and guiding them through their purchase and the proper way to approach the inspection.

 

For the seller, they tried to save money. They didn't need an agent they said. They did not prepare the home for sale either. It needs work. This is why they should have hired a good listing agent who would have guided them before putting the house on the market for these easy fixes before they became an issue with any buyer.

 

NOW, THE ANSWER would be that a buyer can ask for it to be fixed. They can ask for a credit and they can fix or they can back out. The however is there is many variables. Normally we look for health, safety or major structural issues. Not what we can see with our naked eye. When it comes times for inspections, this is where a good agent shines when they are on your side.

 

 

There is a difference from agent to agent.  That a Buyer or Seller should not choose just any agent, choose the BEST agent for the job. My philosophy is simple, provide more personal and professional service to guide my clients through each step of the buying or selling process. All Agents are not created equal and every buyer or seller should take the time to hire the BEST not just the biggest. Those that hire me, find a dedication like no other.

This post also outlines why it is important for sellers to consider professional representation.  So many times FSBOs who are hoping to save on commission, overlook important things that may be revealed in a home inspection.  Or, they may have priced their home because of its known condition, only to have a buyer hoping to further discount price because of it.  A represented seller, would have professional help navigating situations like this one, and likely not be taken advantage of.

Hi Scott, the old adage you get what you pay for is appropiate for those in the situation you described. Why buyers who have no idea of what they're doing try to do a complicated transation on their own boggles the mind. Same goes for sellers.  Ask a professional folks.

Hi Scott... at the end of the day, I rarely worry a lot about inspections. Unless it's structural there's little that can't be fixed or negotiated. If I need to be worried up front, it's something I discuss up front with sellers or warn buyers about.

Having a home inspection is the right of the buyer in most contracts. When the results are in they can then choose to move forward, negotiate or cancel the sale based on the conditions of the contract.

I am not sure there is such as thing on used home sell failing the inspection. Any home brand new or old has code, structure, workmanship concerns.  As seller he should try to reduce the exposure with corrective actions to advise buyers he has corrected some of these concerns. I have never a deal in 13 years where sellers have compensated or repaired as a result of escalation. 100% is as is. You inspect and figure out what needs to be done or fixed. You can walk away (not often) or other buyers are more willing to have the home.

Last sell all offers waived the inspection since seller made an effort to repair what can be done and was open to share the results.
