I am sure by now everyone knows that to conduct real estate transactions in New York State an attorney is usually involved.

It is also a fact that there are many specialties within the legal field.  So, if you are buying are selling real estate you would want to choose a lawyer skilled in this area.  It is similar to if you have a medical problem you would want to use the physician with the specialty that would address your illness.

As Realtors, one of the services we provide is making clients aware of the various resources that would help make the transaction go smoothly.

I personally give my clients at least the name of 3 real estate attorneys from which to choose.  It is also my recommendation that the attorney be local, as he would be more aware of any particular local nuances.

So, if you you are planning to buy or sell make sure to choose your attorney carefully- it can have a big impact on the deal.

Jennifer, the attorney involved in NY in the transaction, as you suggest, should be dedicated to all details of the purchase/sale.  Specializing in real estate (as a lawyer) should be the prerequisite- great advice for buyers or sellers that choose to compensate this involvement.

Wow...that makes the entire thing seem messy to have an attorney involved.  i cant imagine that.  from my experience most lawyers dont understand real estate law. They call me and ask me questions.

Ray (excuse me, Jennifer, with apologies) a good real estate agent can manage the transaction- if a lawyer is requested, that advice/participation is a good thing. The combination of both is not mandatory, if a buyer/seller is dealing with a real estate agent that is ethical.

As out of NY real estate agents confirm, the title company is the element most needed.

Jennifer, I agree having a good attorney to refer is important. I use a real estate specific attorney who is on top of everything. He is a straight shooter, always available and an important part of any successful transaction. I would rather tell people to spend the 250.00 for doc review than them be sorry later.

I second what Joseph said.  Westchester is NOT NYC and it is better to have an attorney that understands the local area.  The few times I've dealt with NYC attorneys that don't know anything about Westchester - it was a wild ride..or at least and "eventful" ride.

I have a simple rule about referrals.  The number of names I give are not as important as the quality of them.  Whoever I send a client to needs to be the best, whether I give one name or ten names.

Laurie - I agree  that a real estate specialty should be a must when seeking representation in a real estate matter.

Steve - Prior to my real estate career I had a transaction that came out in my favor because I had the right attorney who knew just what type of language was need to protect my interest.

Dave - Since this is a common practice in New York, you have many lawyers who are skilled in real esstate law.

Ray - You are so right. I feel confident that the transaction will go well when certain professionals are involved with the deal.

William = Sometimes the buyers or sellers refuses the advice because they have a friend or  relative who is a lawyer.  This can be a problem if this person does not normally practice real estate law.

Laurie - Here in NY most people expect to be representeded by a lawyer.  If you get one party who wants to forego such representation, the other side might not so this would not be a good thing.  As mentioned previously there are language that a lawyer can include in a contract that the typical agent would not think of since the law is not their field.  I have seen lawyers save there clients thousands of dollars.

Ginger - Good to hear from you, I hope your spring is going well.  You raise a good point, the paralegal is crucial.  It is such a pleasure calling an office where the lawyer or his paralegal is polite and never hesitate to provide an update.

Missy - It will be money well spent.  I have heard of horror stories from people who bypassed an attorney.

Carole - It makes life easy when we are able to develop a referral list.  And it is good to know you are sending your client to someone capable.

Diana - This has happen to me too.  An attorney from out of the area is usually unware of somethings so the transaction could run into problem.  I want to say this is not alway the case, I have worked with some wonderful attorney from outside the area.  It is more important to have someone who specialises in real estate.

Ruthmarie - The attorney can make or break the deal, so I find it useful to explain to clients why a real estate lawyer makes sense.

Randy - Quality should be our main objective.  I give a minimum of three names to avoid the appearance of steering. it is my hope the clients will interview all three then choose the one they feel will work best with their personality.

Lanre- That is so true if we want to get to the closing in a timely manner.  I hope you have a great weekend too.

Jennifer, in CA we do not require attorneys in our transactions. Last year I had a buyer from the NY area and she was amazed at how fast we can close on a house. I hope we continue to keep the attorneys at bay, here.

You do provide a great service to your clients by giving them 3 attorney names to chose from. Keep up the excellent work.

One of the great values an experienced REALTOR can provide is in being able to recommend suitable specialists, whether it be attorneys, lenders, inspectors, appraisers, stagers or title companies.

Providing three alternatives for any recommended specialty is a good way to reduce risk and liability.
