Agents Don't Have to Disclose
When you have rental property, anything can happen. The holidays are not always a happy time for people and some get terribly depressed. It happens and we should be alert to signs of depression and reach out to see if we can help.
The call came from a family member of one of our tenants. Our tenant had broken up with his girlfriend and was in despair. He took his life with a gunshot to the head right there in our rental house. The family said they will have the house clean and ready to turn back over to us by the end of the month.
He had been a tenant of ours in four different homes over the last 20 years. It is very sad. This is the second tenant to die in that house. From the owner's and the agent's standpoint, Tennessee law says nothing has to be disclosed unless it has physically altered the property.
Agents are protected under the law from having to disclose. Voluntary disclosure is always allowed unless it is disclosing information about a protected class of Fair Housing.
We will disclose and it will probably take awhile for the house to rent. You never are prepared for something like this to happen. Having rental properties has risks but all we can say right now is Rest in Peace, Friend.
