When we go to the movies to be entertained and receive a story told to us with all creativity, technology and wizardry known our expectations are high and if done right dazzle us even winning potential awards for those that create and deliver this type of experience. The movie industry encourages this as we do too

THE REAL WORLD

However, if we take that magic and incorrectly apply it to what we are representing, we can be subject to criminal, civil & licensing failure. There is a line not to be crossed when we take illusion, fantasy & special affects & use it to deceive, commit criminal acts and for illegal gains at someone else's expense

ABRACADABRA?

Magicians do slight of hand, manipulate the senses and entertain us while they do this. If it is done to distract us for the wrong reasons then it becomes a potential crime or an assault on people who being vulnerable by being agreeable were taken in by the ruse for personal under-handed secretive gains 

PICTURE THIS?

Pictures which are a way of capturing a moment of time by marking an event can serve many purposes. However, if those pictures are tainted, manipulated or falsified in any way they then have another purpose we commonly call fraud, misrepresentation & forgery along with other charges

ORIGINALS

If you go back in time, forgery and counterfeit of every kind was rampant. The first most abused was counterfeiting $2.00 bills followed by $5.00 bills. At first it was sloppily done but then progressed to a high degree of criminal deceit making a special division form in the FBI to counter it all. This is ongoing

DECEPTIVE PRACTICES

Enter stamps, coins, paintings, historic documents and so much more that the courts started regulating all this requiring authentication, testing and certification which triggers a form of insuring what is  presented. We made it complicated but to protect not to confuse. It is a form of anti-crime at work

HEAR YE

In courtrooms, copies of anything were considered inadmissible as they cannot be verified against the original. When they came out with advanced copying machines that could counterfeit money & other documents & items they then had to create other measures to verify like dating & special coded paper

FOR SALE CHEAP?

Real Estate was often used to pull the wool over someones eyes (Brooklyn bridge for sale) until the advent of Title Insurance, inspections and examinations with testing. Why all this? Real Estate is so expensive plus not being a do-over activity that made a loss of any kind devastating beyond recovery

YEARS LATER

That's why the statute of limitations was introduced to further protect buyers who may discover years later they were duped via some questionable maneuver discovered after the fact. Adding to that, licensed and regulated agents were introduced along with a governing body (BRE) to mitigate this

BUCK STOPS WITH BROKERS

As a further stop-gap to injury Brokers were given mandatory supervising authority over all agent activities making it easier to account but more importantly protect the consumer, principals and players in the industry. Brokers added to that with taking out Errors & Omission (E & O) insurance

ESCROWS

These third party entities were formed and licensed by the BRE to insure that no harm comes to anyone during the diligence or fiduciary period while under a conditional contract to perform. A whole system of checks and balances came out of this including strict contract law to govern it from start to finish

If we are upfront and representing that what is taking place is as presented then it is so. AS IT SHOULD BE

So convincing are edited items of any nature that often we are amazed even for the right reasons of being fooled. Pies, cakes, cookies, meals as well as utensils, cars and clothing all are being marketed so convincingly that when we see them in person there is no dazzle but instead the bare-bones. 

DO-TELL

Travel brochures were notorious for doing this as well as pictures of food in a menu. They only capture perfection or the "snapshot" leaving out reality and other dynamics. The consumer has to be protected in almost every type of transaction or consumed item imaginable even with warnings too (labellings)

MANIPULATING FOR FUN?

Disneyland does it pretty well. Clowns make you believe that silliness is fun and Betty Crocker and Sara Lee has made it possible for you to not only be a cook but a chef if you follow the directions of course. Rides stimulate and comedy shows make fun of but we have to know this all upfront and going in

MOTIVES & MARKETING

Truth in advertising addresses quite a bit by introducing in advance what to expect. But ask yourself this. What is trying to be accomplished? Fun, gain, harm, advantage or being so creative that we come to the fine line (the blur) & submit that? Enter the controlling moral Universal force over it all everywhere that is non-negotiable & fair and will not be mocked

DO UNTO OTHERS AS YOU WOULD HAVE IT DONE TO YOU
