DO WE NEED SYSTEMS TO MANAGE INFORMATION?  You bet we do!

Rich Jacobson asks about information management systems.  I'm not a member of the Group because I'm focused on other things right now, but it's a good group and should produce some wonderful ideas and resources for members.  Information management can mean the difference between spending time searching through files or having the information at your fingertips.

BACKGROUND:  Back in the "good old days", the Residential Contract of Sale in MD and VA was 2 pages.  The Land Contract of Sale was 1 page.  If you did a home inspection, you wrote your own addendum for the contingency.  There was no board promulgated contingency form.  Eeek! Talk about agents practicing law.  For instance, home inspections did not really become widespread in Fairfax Virginia and Montgomery County until the early 1990s.  In Southern MD, Baltimore areas, out counties in Northern Virginia, we didn't see them routinized until the mid to late 1990s.  In fact, Virginia is still a caveat emptor state. 

Then, during the late 1990s the contract became longer and longer.  There was an attempt to integrate the areas through a "Regional Contract".  It is used almost exclusively in Northern Virginia, but, alas, rarely used in Maryland where the "Maryland Association of Realtors" contract form is still widely used.  So much for Regionalism.  It will come.  Margaret Woda has done yeoman's work volunteering on the MD committees constantly revising, imporving our ever longer MD contracts.  The lady knows her business. 

The large companies offered secretarial services to manage our contracts.  Once the contract was ratified, it went to the secretary/processor/office assistant and they kept documents, sometimes ordered termite, title, etc.  Life was simple and good.  ALONG CAME STATUTORY REAL ESTATE LAWS.  No longer were agents and brokers advised to write our own addenda (Thanks!!).  The contracts were completely revised and revised and revised until today where a Contract of Sale in Maryland, with addenda, is about 35 pages.  In Virginia, it's shorter, but still can be 10 pages or more. 

DATA EXPLOSION REQUIRES DATA MANAGEMENT.  In the mid 1990, when I left the comfortable surroundings of the mega broker and began working from home, case management became more difficult.  Every piece of paper in a file had importance.  Case management had to be organized and immediately available.  When you're managing 3-5 buyer or seller files at a time, it's manageable.  However, once formed Homefinders.com the brokerage and hired agents, I had to manage contract information for my own sales, but need to be able to keep records and manage data for agents sales. 

SYSTEMS ARE IMPORTANT.  THEY HELP CASE MANAGEMENT AND REDUCE RISK.  In 1999, after experimenting with several commercial data management systems and finding them to be very time consuming and not geared to Buyer Agency, I contracted with an experienced programmer to design a case tracking system just for my business.  It's not perfect, but it works.  Case management is so important to real estate practices with any volume.  At it's peak, Homefinders.com agents closed over 200 contracts a year and that is serious case management.  There is also the matter of tax returns, 1099s, sales and financial reports, etc. all of which should be available at the management's fingertips in seconds.  I also wanted a system that was Internet based so it could reside on MY hard drive and not that of a supplier.  That is the system I wanted and we came pretty close.  

THE BEST SYSTEM FOR INFORMATION MANAGEMENT IS THE ONE YOU USE.  The important thing is not the system that an agent or broker uses.  The important thing is that a system be available and be used.  The system I designed permitted me to pull information for 1099s in minutes.  There is a category for agents that includes the agent name, address, phone, e-mail, tax data, licensure, etc.  A comprehensive information system saves money in accountant fees.  The system also permits reports for agent/broker income for sales reports.  For some reason, whenever one of my agents would buy or refinance their home, they never had up to date income information for their loan officer.  So, they called Lenn and I could send it to them in minutes.  Such informtion from an employing broker is helpful when self employed agents need mortgage financing.  It removes the spector of the underwriter suspecting that the agent is "estimating" their YTD income.  Good information often makes the difference in getting a "full doc" interest rate or a more expensive one.

Barbara.  For me, it was a matter of having the database so I could keep financial records, then I added the case management which gives wonderful supervision ability.

Lenn, there are many systems to use. Today, data tracking, filing almost needs to be done via a computer application(s).  But it does not stop there.  Whether it is formal or not, you have to have a system to run your business.   From marketing to tracking your metrics, to have consistancy, you have to have a sytem. Lenn,

The reason I ask about why people aren't using them is that we are always throwing around ideas for products we could create that agents might find useful. I was expecting you to say that the biggest barrier to entry was complexity.......I guess you kind of did say that......

What do you think, would people use a free database program if we built it and made it really easy to use and search?

Lenn, For the volume I produce I've got a searchable online system with local soft copy and hard copy backup. I refuse to have a single point of failure in any of my systems. Layers mitigate risk and enable continuity of operations.

Bob.  Indeed, that is what I said.  When I was testing off the shelf systems, some of them were very complicated and time consuming.  One was so complicated, I figured I would have to hire a clerk to enter the data.  Data could only be entered into a "field" but not on a form.  That's the key to my system.  You enter large amounts of data and then it's uploaded to the individual case file.  Corrections can be made one section at a time.  Very simple.  I designed my system so that any agent who could enter a listing in the MLS could use the system.  Of course, they were my agents and had no choice.  There were absolutely no exceptions, but our agents easily learned the system and used it. 

Three steps and it's ready.  For quality control, all fields have to have an entry.  I do, asolutely believe that if ActiveRain has a simple system that agents could use, password protected, that it would be used.  Further, it could be another non-profit center for ActiveRain.  I paid about $12,000 for my system in 2001, but with the programmers you folks have, this should be a breeze.  Unless it slowed things down further, sshhhhhh.

AJ.  Indeed.  You'd be surprised at the number of agent who don't.  Of course if you only sell a few homes a month, you don't really need anything more than a calculator at tax time.

Craig.  You have technical expertise.  Many of us don't.  But, the end result is the same, risk reduction and quality control.

Lenn-  Yes, you are right and this is a big thorn in my side and I am learning a hard lesson with taking 3 weeks to gather all the docs for an audit with our uncle. What has held me back is the complexity, I hate Excell, I don't want to learn boring cells and such. We use outlook for our data base of clients. Nestor spent a ton of money on ACT and before that Top Producer, both I can not stand and ACT is so expensive for support. HE is going to switch to outlook. But for records it is still old fashioned and in boxes in the attic. As we hire on agents this will have to change.

Now that we hired a closing cordinator, I set all our files up on google documents in files so we can see the work being done on them in real time. Changes and notes added are able to read by Nestor, Gloria or myself at anytime. Plus we can access it from any computer.

For our listing management I use the FAR included with our membership, document storage and filing system. But it still has glitches and does not have everything for closings, the financial stuff is lacking. IT is also too time consuming.

Bob- I would be one that is very interested in something your programmers create that can emcompass the whole enchalada.

Lenn, I wish I could say I was that organized but I'm not. My data base is a mess!!! BUT....I do know where everything is at. I went paperless about 3 months ago so now I'm putting all of my transaction files on disc. I had to since my closet is full of file boxes:)

Paperless is working out pretty good. I'm about 80% there. I use a tablet PC so I'm able to sign everything on screen and then just email or efax.

My biggest problem is my database. But since most of my sellers are just moving on anyway, keeping in touch with them has really never been a priority. Now that I'm starting to get  a lot of Internet business it's becoming necessary to get my head around it though. It's on my list of things to do :)

Hi Lenn - I've used a contact manager/database management software program for years and cannot imagine trying to work without it.  I don't know how anyone who does business can do so without some kind of system in place.

Like Monika said - the one that works is the one that you actually use.

I would love to see a user friendly system like the one Lenn outlined (hint hint)  it sure would be a big help- I am notorious for using the paper system-however, it doesn't crash and my pencil never suffers from screen freeze.

Lenn- I agree that the best system is the one that gets used. I am so suprised by the lack of systems within the real estate industry. We all seem to run on the seat of our pants. I'm working on developing my systems for my business but I will confess it is not much of a priority.... I tend to do things like post or show houses or wash the dog before doing work on systems.

Monika.  The law says we have to keep our files 5 years or something.  I have the files, but I also have a system whereby if a former buyer calls me and asks who their title company was or an agent needs info or a past client, it's at my fingertip.

Ann.  Absolutely.  We need systems and we need to use the systems we have.

Joan.  The paper involved in a real estate transaction is awesome.  I don't like shuffling papers.

Anon.  I suspect that we might see something out of AR for this purpose.

Lenn, I still keep some of my "One page" land contracts around, that I used 30 years ago....they remind me of a simpler time....maybe not better, but simpler.
