What sounds like a trick question, was more than real when a Manchester NH area Home Owner decided to not let buyers see their home. They were selling as a FSBO. They also decided they did not want to move until the weather turned warmer. They called looking for help when a home buyer said they were going to sue.
Telling them they needed a lawyer and not Realtor was the common answer as they called agent after agent. That was until they called me. I listened to what she was saying but it did not make sense. The problem was that they signed a contract for a buyer to purchase, then decided they wanted to wait to sell. It definitely sounded like a problem for a lawyer to solve EXCEPT...
They did not have a valid contract to sell their home. The offer was from a buyer without an agent. Where the sellers did not have an agent, the contract looked like it was written by a school kid. No offense to school kids.
It did not meet any criteria for being a contract. Was not signed. Did not state a clear sales price, no closing date and no deposit was paid. SO there we had a couple who thought they were buying this home that are not. Then a seller looking to sell who can not get out of their own way.
I was hesitant to offer any advice as I am not a lawyer and not their agent. I know a great lawyer and that is who should draft a letter to these buyers. They agreed. I also know a Great Realtor who can help them list and sell their home. That would be me.
They agreed to meet. I started from the beginning with how a house should be listed. I went over what the home selling process would be and what they should expnoect. I went over their homes value, what price they should ask and what price they may get. I went over how long it takes on average to sell a home. Lastly I went over why now is the best time of year to list and sell. We have a shortage of homes for sale in many neighborhoods. Buyers buy in any weather. The sellers were overcome with emotion. Before I can take a deep breathe it was in a good way that they were finally on the right track to sell their home.
Wait, What about that buyer. Wouldn't it just be easier to sell to them? Yes it would, but they are not even pre qualified and can not buy this or any home without some work on their credit and saving the money needed to for a down payment and closing costs.
The MOST IMPORTANT message is to share with every consumer that my philosophy is simple, provide more personal and professional service to guide clients through each step of the buying or selling process. All Agents are not created equal and every buyer or seller should take the time to hire the BEST not just the biggest. Those that hire me, find a dedication like no other.
