Yesterday, I wrote a post about a closing scenario and a request for solutions. As promised, here's what happened. By the way, if you haven't read my post from yesterday this one will make no sense. I'll wait.......OK, so here we go. First, my biggest problem was that it was late on Friday and I couldn't reach the other agent or the LO. They had both disappeared. Redoing the contract or the closing docs was not an option (remember the dual closing). My Sellers were in another State, sitting at a closing table, waiting on funds from this closing. My Sellers, so far, were not aware of any issue and were waiting to hear from me, that the deal was done.

The Buyer, the agent and the LO had been fighting for days. Who was at fault? Don't know. Don't care. All I knew is, it was ugly and none of them were speaking to the other ones anymore. I won't get in to how unprofessional that was.

Anyway, as Lenn Harley, stated, it was a "no brainer", I paid. My only goal was to get the house closed for my Sellers. I ended up contributing $1,800 of my commission and the title co. reduced the costs by $400. The deal closed.

The Buyer said he would give me a note for the money, as Bill Leider had suggested, but I declined, for two reasons. One, I was not sure if that would be legal or not (probably not) since it basically would be a loan outside of closing. And secondly, chances of me getting paid back were probably slim anyway, so why put myself through the stress. Chip in and be done.

The title co. contacted the lender direct and they said they would allow the Seller to pay the property insurance in the amount of $1,800. The insurance was switched to Seller's side of the HUD and I reduced my commission accordingly. The Seller was informed of all of this when I called them and faxed over a new HUD for signatures. They were very pleased that I solved the problem without getting them involved in it. This entire process took about 15 minutes, from the time I was made aware of the problem, until it was solved.

The Buyer got his house and my Sellers got their money and their new house. Instead of making $7,500, I made $5,700. I never heard back from the other agent or LO. They got paid all of their commissions and fees.

Why would I do this? Why not make a stink? Well, my Sellers had hired me to get the job done. They were counting on me. We had also become friends and there was no way I was going to leave them hanging with their other closing. I needed to get this deal closed as painlessly and as quickly as possible and I did. I didn't "lose" anything. I made $5,800.

Three weeks later, I got a call from my Seller's old neighbor wanting to list his home. He was given my number by my Sellers. I listed his house and sold it in a couple of weeks for full commission. It was a very easy transaction and I made $6,800 from it. Moral of the story is: Don't get caught up on dollars, solve the problem and move forward. It WILL come back to you. Was that fun?

Almost forgot, the Buyer called me last month to list the house. He closed on it in June and is already in foreclosure. Unfortunately, since values have dropped, he owes way more than the house is worth so I turned him down. Made me kind of sad actually. He was raped by the LO and the REALTOR®. No one looked out for the Buyer. It was all about the dollars. Please don't conduct your business that way. Broker Bryant says, "Real Estate is about people(relationships) not money." What say you?

Not many salespeople do the things that we do. Folks get so caught up over a few thousand dollars that they miss the bigger picture. The referrals and the good will are worth more than the stress that we and the Seller's would go through over a small amount of cash.

This is what forward motion is all about. Pay up, solve the problem quickly and move on to the NEXT deal. What say you? :)

This was kind of where I was going, but bottom line like you said above were hired to get the job done! Most often than not there is a way to work things out. Everyone just has to be willing to participate and set aside their personal interests. You did a good service you preformed as a professional!

You kind of resemble Slim Pickens! ha!

good to hear someone else getting title to reduce fees... they do work hard for what they do but there's plenty of room in there to wiggle...

that's why I like using my people - they know me and they'll pull fees to help my clients because they know there's another transaction coming for their continued flexibility.

As a Mortgage broker... I would have been on it and you would have kept your 3% - or at least only chipped in some... I would have negotiated a compromise with all parties to make everyone happy... but the buyer's agent should have been put on notice for this one... and his/her broker.

If that is a local farmer - that deal could have stunk it up for that agent and the whole company

Danny, I was feeling for you yesterday. You were right on with the limited info I had given. I'm all about getting the deal done. I've seen folks willing to walk over a $100 bucks!!! I had no intention of making a post out of t his but it got away from me, so figured what the heck. Now I freed up my day to comment on your posts:) It all gets back to that time management thing.

Ines, I have NEVER received an A+ before. Whoopee!!! I too felt for the buyer. I knew at closing he was screwed. The payment was something like $2,500 PITI. He was raped bad by his "team". Very unfortunate. But what can you do? I had to look out for my sellers.

Thesa, The relationship is everything. I think a lot of folks make the problem of being too short sighted. You have to see the big picture in this business and life for that matter. And it is definitely not all about the "principle". It's about looking out for your customers and clients and putting their needs, first.

David, I'm with you. The easiest way would have been for the LO and agent to sort it out. Unfortunately, by the time I was made aware of the issue (by my closer) we couldn't reach anyone. They were both small independents and all I got was voice mail. At that point I just made the decision to close and move forward. My time is too valuable to worry over $1,800.  Plus it helped me to solidify my relationship with my seller. To me, that's worth a few bucks.

It always saddens me when I am at a closing and I see the buyer's getting "raped" by the lenders for anything and everything.   I look at these agents who are supposed to be "buyers agents" not having a clue and not pointing out what I would be ..   like Hello...   you don't need to pay 16 points and an origination fee, application fee, lock in fee... fee fee.   

And your client, you just know that these poor souls are destine to fall behind and the purchase of a home which should be looked as a huge step up and a major accomplishment for some.  The odds are already stacked against them and no protection or concern from the parties supposed to be representing them

Not only was your choice a great one, but you really didn't have another one since no one was answering their phone and your sellers were waiting at another closing table for the funds.  We've also had to take the initiative to pay part of the buyer's closing costs to get a home sold for our sellers.  It's not all about the $$.  So many people say that, but very few show it.

Bryant....  First, great job and yes, you still made money. The bottom line, referrals out of this scenario. But I would have come up with that answer, but you had mentioned that the seller gave a full 6% of the costs.  I guess the lender would allow for the seller to pay for the home owners.... but I wonder what kind of loan this was then. Because under FHA, this would not be allowed, no matter what. In the sub prime world, I think you could get away with this with some.

Overall.... you did exactly what the lender should have done. Great job....

Glad for the sellers and the buyers that the transaction closed. Glad for you that you didn't have to remarket and resell the home for $1,800. Glad to have people in the business who look at a lifetime rather than a transaction.

Bravo, Bryant. It is what I expected you to do. Glad it worked out. And when you do the right thing, it DOES reaps it's benefits in one way or another. I feel badly for the buyers - it was ugly to start and now getting uglier. Wonder if the LO and Buyer Agent have a clue?

I knew you would step up and cover your client.. this is what excellent agents always do..  We stand by our promises to our clients.   This is the difference between you and the other agent... you will continue to be wildly successful(which the other agent will call luck) while he will leave real estate and go back to selling widgets... or whatever..

When I read this yesterday, I was the one who wanted to understand how it could happen. I learned something very valuable today. It really doesn't matter much at this point. Without your comprehensive explanation I think I still would have missed this one. I think I forgot who you were working for as I initially read the story. This is one I will store away for future reference. Thanks immensely.

BB, you handled this sticky situation great, but I figured out as much, knew you would "get ir done". I am ashamed the other agent didn't step up and work this out with you before hand, and if you think about it, you were actually only out $900.00, because if the other agent had split it with you, that is the amount you would have paid. So you come out the hero, and the other agent comes out smelling like poop. I would put this guy on my never to do business with again, if possible list. And again as you said "I didn't "lose" anything. I made $5,800".

Way to go!!!

One more example of how pathetic the entire lending industry has screwed up the housing market.  Last year it was "Fog a mirror?  You qualify!".  Fortunately, the subprime lenders are folding and standards are going up......the faster the better.

Another great job by BB....sorry you had to pick up the pieces from those slimbags.

Broker Bryant - Thanks for sharing how you handled the situation, though I suspected from what I've learned of you through your postings that you would have stepped up and taken care of it to get the job done. Good for you and congrats on the resulting listing referral.

On the other hand, it is disheartening to hear that the buyer's agent and loan officer didn't even contact you to thank you for making the deal happen. Goodness! That's just terrible.

Lastly, it's sad to hear that the buyer is now facing foreclosure.  I hope they find a way to make it work.

I suspect that the LO and agent never contacted you to thank you because they knew the deal was bad and they never should have been  a part of it.  They might have been secretly wanting it to implode but the fact was that they let it get that far and their client was sleeping in a UHaul.  that's just sick and wrong.  No wonder people think Realtors are snakes.

You obviously did the right thing and your actions have been endorsed by everyone in AR, but you stopped short of 1 final item.  -- Protecting your industry.

Agents and Lenders that operate with reckless regard for their clients are not only bad for the client; they're bad for our industry.  At a minimum, call the broker and review the details of the case.  We don't need guys like these giving us bad press and we certainly don't want them to rape their next (clients) victims.

Keep up the good work, that's why your clients love you.

Bryant, good for you.  I meet too many real estate agents that live by the motto, "whatever you do, DON'T touch my commission."  All this said with teeth gritted.  When I encounter those I make a mental note of them.  The funny thing is that as intelligent as they are, they still haven't figured out that 100% of "no deal" is nothing.

Thanks all for visiting and commenting. I thought this little exercise turned out pretty well. It's paramount in our business to remember who we work for and that we were hired to get the job done. Sometimes we have to make quick decisions and may not have the luxury of knowing who is right and who is wrong. I could have very well just told the sellers they needed to contribute more and NOT reduced my commission accordingly. The deal would have still closed. But would I have received the referral that netted me $6,800? I doubt it. My opinion is to never worry about the money or base my decisions on it. Step up to the plate take the action of least resistance and move forward. This attitude will build long term relationships and before you know it the business will come pouring in all by itself.
