I was recently divorced and my husband gave me a Quitclaim Deed. I have never heard of this type if deed. Is it a good deed?

Answer:

Hi Rachel,

There are three types of deeds in Texas; General Warranty Deed, Special Warranty Deed, and a Quitclaim Deed. Unlike most other property deeds, a quitclaim deed contains no title covenant and thus offers the grantee no warranty as to the status of the property title. It is a risky deed that many title companies do not allow when insuring a chain of title. You should obtain a General Warranty Deed in this instance.
