By
Education & Training with Lauren Massie, CPA PLLC

Is the IRS taking money from your paycheck or threatening to do so soon?   If so, the reality of not getting your normal paycheck can be extremely stressful and scary! Good news! There are options to get your wage garnishment released! The main focus of my tax practice is income tax representation for individuals. Many taxpayers who come into our Raleigh, NC office contact us to stop a wage garnishments issued by the IRS or the North Carolina Department of Revenue. Below is additional information about wage garnishments and how to get this type of tax garnishment released.

IRS Wage Garnishment

Without getting overly technical, a wage garnishment is a harsh action that the IRS takes to get taxpayers to start paying on an overdue tax debt by intercepting a portion of their paychecks. Wage garnishments are intended in many cases to create a hardship for the taxpayer to get their attention after several IRS tax notices have gone unanswered. In fact, the amount of the garnishments can be so severe that it can threaten a taxpayer’s ability to meet their regular living expenses. Fortunately, there are solutions for taxpayers to get their wage garnishments removed if certain requirements are met.

Wage Garnishment Removal

In many cases a wage garnishment is intended as a “wake-up” call by the IRS to get taxpayers to contact them to discuss a resolution option available under the Fresh Start tax program. Fresh Start resolution options include settling tax debts for a lesser amount, placing the account in an uncollectible status, or in many cases setting up an installment agreement to pay the debt over time. The wage garnishment will generally be released once an option is agreed upon. However, before such options can be pursued a taxpayer must get into compliance by filing any back taxes or unfiled tax returns among other requirements.
