Louis Cappelli of Ritz Carlton Fame takes White Plains to Court Over a Granite Slab – While Affordable Housing is STILL Not Cost-Effective

pngWhy do I have this slab of granite featured in my blog? It’s just a slab of granite…..Why all the fuss…?

It’s a loooooong story. But I’ll give you the short version.

As you can see, the slab of granite has “The Ritz Carlton” engraved on it – and as such, the slab is there because Mr. Cappelli (who built the Ritz Carlton) wants it there. In fact he put it there. But you can also see that said granite is located on a road median. Therein lies the problem. It is located on the median of a PUBLIC road.

This piece of granite has been the center of a controversy that has turned local public meetings at City Hall into City Brawl. The mayor wants to be able to sell the traffic island to Cappelli and indemnify the city against any liability the granite imposes. The council are concerned that this sets a precedent which is not good.

Not only did Cappelli refuse to take down the sign, he threatened to film any crew from the city that attempted to remove the sign and show the film to developers as a warning not to submit any building proposals in White Plains. Later he went to Westchester Supreme Court to prevent the city for removing the slab.

Comical as this may seem, there is a precedent to be concerned with. Once one business is allowed to put signage (without prior permission) into road medians – how many more would follow. Looking at the long highway median along Mamaroneck Ave.– it is quite possible that it would literally be overwhelmed by business signage. I’m sure the White Plains Beautification Foundation would be thrilled that all their hard work on the 2.5 mile stretch on the Mamaroneck Ave. and Bloomingdale Rd. highway medians could easily be littered with signage from local business who would probably develop a “me too” mentality.

Meanwhile, with all this time and energy being spent on the famous “sign” – there has been NO FURTHER PROGRESS for the affordable housing that Mr. Cappelli promised to build. Mr. Cappelli appears to have a very a misplaced sense of priorities. Way too much time expense and resources have been spent over a this slab of granite. The agreement was that the affordable housing was to be built BEFORE either tower opened. The city council graciously allowed the first tower to open, but given their stand on the granite slab, they are probably in no mood to let the second tower open until the affordable housing is complete. I will say again what I said before: Mr. Cappelli, quit your whining about signs, and all the other insults you feel the city council and the people of White Plains have heaped upon you, and BUILD THE AFFORDABLE HOUSING!!! The clock is ticking on the second tower of the Ritz Carlton. It is supposed to open in August. Tick-tock, tick-tock.

The Mayor is wrong Susie. The Council is right. Get the sign moved. The Ritz may have big lawyers, but they can't win this one. It is not OK to keep the sign. But they should get a steep fine for putting there in the first place.

The whole thing is surreal....So much time and energy and MONEY wasted when they could be working on the affordable housing and getting that second tower OPEN!

That's crazy.  It sounds like the only reason they're hesitating is they're afraid of aleniating him and his money.  That's too bad.  I've been reading your ongoing blogs about the affordable housing he was supposed to build for a while now... guess the granite slab takes higher priority right now. :/

It really is crazy... What bothers me is the time and resources that are being wasted on this stupidity!  If you have the $$$ to go to court over a slab of granite - and have made billions in White Plains, you have the $$$ to deal with the affordable housing issue.  That's the "cost of doing business." No one ever said it was "cost effective."

If you have the $$ to go to court over a slab of granite...  I agree with you completely.  The thing is I'm guessing he has no interest in the 'affordable housing' and only agreed to it as an inroad to the high rise moneymaker(s).

Jesse, I never thought he cared about the affordable housing. That was the price of doing business in White Plains.  But  he counted on his pal (our mayor) for helping him to wiggle out of the responsibility.  What he didn't reckon on was that the public got FED UP with the increasing infrastructure costs, rising taxes and soaring prices that high-end housing brings in.   They were sold a bill of goods that this would SAVE them money. It didn't. Now they've got a city that they may not be able to afford to live in.   As a result, the elected a NEW city council. In the backlash - 2 new council members won in a tight election last year and they are NOT laughing at all of these little "transgressions." They don't find it at all amusing that Cappeili started a new building project without bothering to get permits.  THey didn't "buy it"  when Cappelli claimed he didin't "understand" that he didn't have the right to add two more stories onto  a 40 story building that already required a major variance for air rights.  They have been grim faced and not at ALL nice to poor, poor Mr. Cappelli!

But the City Council has a HUGE dilemma coming down on them hard and fast.  We are in a recession.  Buyers are buying into the second Ritz Carlton tower. The agreement was NO C/O for the hotel or EITHER tower if the affordable housing wasn't ready.  He has delayed and delayed. Found excuse after excuse not to begin the process. GROUND HAS NOT EVEN BEEN BROKEN...yet the second tower (and the only remaining hold the council has to force him to make good on his promise) is set to open in about 2 months....

So now....what do they do?  Oh the drama - The saga of the granite, affordable housing and C/O continues.....
