I represent taxpayers in the greater St. Louis area and the state of Missouri. If you have identifed by the IRS as having an outstanding tax issue you are now in the collections arena. In order to get the IRS off your back first your have to be in compliance which means all tax returns have to be filed and you must be making estimated tax payments or proper witholding from your paycheck if you work for someone else. To find a resolution to your problem the IRS will review a taxpayers gross monthly income and reduce it by the allowable expenses determined on a local and national level.
Any agreement will be determined by the remainining available cash after the allowaable expenses are deducted. Depending how much time is left on the statute of limititations will determine what type of payment plan someone will be eligable for.
This form also determines if a taxpayer might be eligable for an offer in compromise or non collectable status.Note that is if the balance owed is under a certain dollar amount a taxpayer may not have to complete the form due to qualfication for a guaranteed installment agreement if other conditions have been met in the past.
Once you have gone thru the mechical part of the process it is important to know that to continue in any arrrangment agreed by the IRS you must stay in compliance.
A tax payer will default on there agreement if any of the following occur.
* incurring a new tax debt by filing a tax return with a balance due.
*Failing to file a tax return in a timely fashion which creates a late filing penalty.
* Not making their payments as agreed.
