Is Your Real Estate Video Legal?

It's been a pretty wild ride this month in the real estate video arena.

I actually got kicked out of a Facebook group for suggesting it was not a good idea to spam real estate agents.

I'm told I violated the group's terms of service for disagreeing with the group moderator. He was pushing a CAN-SPAM prospecting strategy to sell videos to real estate agents.

CAN-SPAM first-time violators can be smacked with a $16,000 fine.

Call me old fashioned, but I think it's stupid to adopt a prospecting strategy that risks a $16,000 fine.

What may be worse is expensive training that shows video creators how to create real estate videos that don't comply with state rules and regs.

The good news about video is the enormous potential to create new conversations online, build brand awareness, and attract new business.

The bad news is a quickly expanding bank of real estate video content that exposes gross violations of copyright law, antitrust, fair housing, and license law, as well as violations to the National Assn. of REALTORS Code of Ethics.

Real estate agents and brokers have to meet both legal and ethical standards for online behavior (including video posts).

I am going to cover these points in a Facebook Live podcast tomorrow - Judith Aussem's "You Can't Be Serious".
