What happens when a Buyer agent will not take no for an answer

Persistence we like, be crazy, not so much... Here is the situation. The seller asked for highest and best offers without any contingencies on a new Manchester NH area home listing. The seller chose the best offer that was free of any contingencies. There was one offer just sightly higher, but is was contingent on everything that it could be contingent for.

 

The Buyer agents checked every box and put the contingent dates out 10 days. The seller said no contingencies. The seller chose the offer, signed and accepted it. However when the buyer agent was notified their offer was rejected, they had a break down. In a dozens of calls, messages and emails they said their offer was not contingent on anything. A quick look back at the offer and carefully reading it and yes, it was contingent on every inspection known to man. 

 

Then the reply came that it was a mistake, they meant to check the no box. Going back to the offer there was an another additional clause typed in that the balance of the deposit would be paid upon acceptance of the inspections. SO checking the wrong box, could happen. Typing that clause, not so much. 

 

The seller chose another offer, they signed it, the buyer paid the deposit and is closing next week. Sorry, but no, the seller will not be selling to you. Next time, take time, write your offer correct. Next time, take time to proof read your offer and review the offer instructions. The buyer was left puzzled. They did not ask for any contingencies yet also signed an offer they may not have read. 

 

 

 Perhaps the MOST IMPORTANT message is to share with every consumer that my philosophy is simple, provide more personal and professional service to guide my clients through each step of the buying or selling process. All Agents are not created equal and every buyer or seller should take the time to hire the BEST not just the biggest. Those that hire me, find a dedication like no other.

It doesn't happen every day, but it does happen.  I have memory of a buyer agent, who wrote a lowball offer with all sorts of odd ball contingencies, even after being told that I was presenting two offers to the seller that evening.  The seller accepted one of the other offers, countered with a potential backup position for the second, and outright rejected the lowball offer.  And, like you experienced that agent became enraged and had a total meltdown.

Hi Scott... when I first started in real estate in Charlotte almost 21 years ago, I remember receiving a call from an agent thanking me for writing such a "clean" and complete offer for my client. I was a bit taken aback at that. Over the years, having received many an offer from other agents and seeing how sloppy they are, I now understand why that agent was moved to call me to say thanks.

That is a nice call to get Nina Hollander . I can tell you just this week ho wmany bad offers i got on my new  estate sale listing where the bank is asking for highest and best. Low offers, missing names, missing closing date on 1 even.
