Showing homes with pools. I pay attention to the height of the fence.

The pool fences that I pay attention are not just the ones that go with the homes, but the community ones also.

So, here is my question. Is there a said height that is needed for pools. Maybe the insurance companies a requirement that are different than the county and/or the restrictive covenants?

What if you move into a subdivision that you can put a pool in the back yard, but the county requires a 5 foot fence and the restrictive covenants say no fence above 4 foot? Then what? Can you get a variance? from the HOA?

Does anyone know anymore on this matter?

Good question. Seems the HOAs can easily be in conflict with county or local ordinaces on something like that. Probably would need to verify with the county then approach the HOA for a change to the restriction.

Thomas  - Seams nobody takes the time when writing the orginal covenants to check with conflicts that might need changed down the road.

Susan I not sure what the height requirement is around here, but I would think that zoning regs would govern and the HOA would HAVE to change their rules to comply.

Susan - I wouldn't think a HOA could prevent compliance with city regulations. Another consideration for pool fences is insurance requirements - sometimes a property can be in compliance with both the neighborhood and the city regulations, but not be eligible for insurance without additional fencing.

Sharon -  It is not in the city, weather that matters. I talked to the management company yesterday and it seems that they believe the height is good for them.
