A recent article in GazetteXtra.com (Janesville, WI) spelled out some very interesting facts and dispelled some of the myths of title insurance. More importantly, it underscored the confusion that exists among consumers, agents and brokers alike, regarding title insurance. It is a good read and very informative.

Since my introduction to the mortgage industry, many years ago as a mortgage wholesaler, I have literally looked at 1000's of title policies and settlement statements and spoken with hundreds of title agents, but never had more than a cursory understanding of exactly the mechanics of what a title policy accomplished. That is until I got into the title industry.....wow, was I surprised!

Now, I could go for hours, do seminars and webinars with charts and graphs and testimonials and stories with facts and figures and literally bore most of my audience to death. But, I am a strong believer in developing relationships that delegates those things to people I trust. That is not to say that I do not need to know a little about the services of the professionals in my network. In fact, I think it is a little irresponsible not to. Case in point, I do not pretend to know everything about a real estate transaction, but having the right real estate agent who does, makes the link in that network stronger. The end result is creating a vertically integrated network of professionals in each facet of the process (the real estate transaction) that can answer questions, give the best service, and ultimately have a hand in nothing less than a fantastic experience for the consumer.

Having said that, my goal is to be the absolute best at the title piece and foster the trust necessary to strengthen my link in the process.

Title insurance is NOT a necessary evil, but a critical part of the real estate transaction that protects all those involved in the transaction against inherent problems of propery ownership transfers, more an "assurance policy". Those risks are mitigated by the title insurance company, so that if something does occur or comes up because of a past dispute or mistake, it will be handled. I have personally seen this process in action and can say, no one wants to be involved in a claim or dispute without it (title insurance).....it can get really messy!

Pick a good title agent, they really are an integral part of the transaction.

Title insurance is not a necessary evil.

It is necessary, and helpful. I always encourage owner's title. I purchase owner's title myself. Several I know just want the minimum lender's coverage, but I think that is a bit of misguidance.

Getting protection for title issues is just as important as getting protection for home value from a good appraiser, or for home damage from a home insurance policy.

I would not do a transaction without it... period. Yes it can be expensive but relative to the total transaction???

Richard Smith ~ I mirror your thoughts exactly on this. Owners title is critical to protect the leagalities of what ones has purchased. The insuror (Chicago Title, Fidelity, etc.) shoulders the liability and thus the responsibility of insuring that your property description (metes and bounds) is corrrect and indeed belongs to the owner of the house. ...thanks for you comment
