It would be a rare exception to represent a buyer on the purchase of a probate home. Recently we made such a rare exception and agreed to represent buyers on a home being sold by the Santa Clara County Public Administrator.
All home purchases need to be made with eyes wide open, fully informed of the process, and risks. While many aspects of buying a probate home are similar to buying a non-probate home, the process of buying a probate home is different and requires specialized knowledge and experience.
Buying any home with zero contingencies is risky
The home being sold by the Public Administrator required non-contingent offers. It also may require court confirmation and be subject to the overbid process.
Probate home sales are not one size fits all. Most do not require court confirmation and are not subject to overbidding.
Buying a home sold by the Santa Clara County Public Administrator means a detailed process must be followed, including submitting offers in a sealed envelope with a Cashier's Check equal to 10% of the offer price.
