Go Lisa!

Our Illinois Atty. Gen. Lisa Madigan is filing a lawsuit today against Countrywide Financial Corp.

Madigan claims that the lender engaged in “unfair and deceptive” practices which enticed people to get those risky, adjustable mortgages back in the good old days of 2002 to 2006. You know, the mortgages that are now in foreclosure…or close to it.

And, of course, Countrywide is not the only lender who gave away money. So many lenders have or will disappear within the next 18 months, that when the smoke clears the landscape will not be recognizable.

Perhaps, we’ll go back to the old, old days of purchasing a home if we have 20% or more for a down payment. Perhaps, we will have to have a job and an income that makes the mortgage payment affordable.

Imagine that we may have to have money in savings! Yes, savings. A forgotten concept with this generation. If nothing else, this depression in housing and problems in the financial arena should make us all become better financial stewards of our own resources.

As parents we should be teaching our children about savings, rain day accounts, using credit cards sensibly and living within our income.

Can we do it? Can we become examples? It’s certainly worth a try.

I do not know if we will ever go back to 20 percent down with the price of houses where I live.  However, everyone should have to have a little equity in their home or it is too easy to walk away from.  A job would also be nice.  I feel for those who can not afford their homes now, but not for the ones that do not have to move and their value has gone down so they bail.  Real estate is a cycle and the value will go back up, they signed a contract and should pay

Eileen.  Yes, we are our own demise.  Fortunatly, through the buying and selling of real estate I have been able to have a good loan to value on my personal residence.  I do not own a credit card.  I hope I can teach my children the same. 

However, I do not agree with someone suing countrywide.  If I ran into the back of someones car today, can I blame my balckberry?  NO I should have paid more attention.

Yes...real estate is a cyclic business. I bought some property in the mid 1970's. I had to hold it 20 years in order to sell for a profit. I didn't walk...it was a good but expensive learning experience.

Our attorney general is suing because Countrywide committed fraud and generally didn't follow all the rules and regulations necessary. The FBI had a sting across the country which netted 67 real estate related people in the state of Illinois. I'm sure that Countrywide was involved in some of those fraudulent loans.

Paying attention is important, agreed. But, if a loan officer lied to you and you believed him/her...then what's  your recourse? We're a nation of laws. Unlike some countries we don't kill or imprison people (terrorists excluded) without a court hearing.

As a former teacher, AMEN! Teaching our kids how to read and think logically...or at least think would help a tremendous amount. I was at our MLS office earlier today and on the way home I heard a radio commercial about a woman who could "help" you become "rich." Just call and order her book and tapes for free! Yeah, right. But, I guess that there are a lot of people who believe what they hear. How sad.

This just in from the Chicago Tribune's story:

Attorney General Lisa Madigan filed an 81-page lawsuit Wednesday in Cook County Circuit Court against Countrywide Financial Corp., the nation's biggest mortgage lender, alleging that it engaged in unfair and deceptive conduct in creating, originating, marketing and servicing what turned out to be many unaffordable mortgages for Illinois homeowners.

Washington state is after Countrywide as well.  Read a news story yesterday that our Governor is threatening to pull their license here!  Plenty of blame to go around the current state of the market, but it looks like Countrywide is now paying the piper.
