The Buyers closed in June, took possession in July, and two days after they moved in, I got a call.
How do you deal with neighbors that run their music at 2 am and won't turn it down? These Buyers went over the first time very nice and asked if they could tone it down after 9 pm. He said yes. Two days later, it was loud once again. They went over and asked again, and the neighbor said he has lived there 20 years and that is how he lives - get over it!
The next day I called our State Legal hotline, and the Seller did NOT need to disclose this information. He also suggested making an appointment with a real estate attorney and sending a letter to this neighbor.
They are now calling the Police, but miraculously, the neighbor knows when to turn it down, and is off by the time the Police arrive, which seems like it is affecting my Buyers' credibility. I have always thought there was a noise ordinance between 9 pm and 7 am. A homeowner should be able to live a peaceful life.
In those first days, they moved from their master bedroom (on the backside of the home on the neighbor's side) to the basement bedroom. They have bought noise filtering items to keep the noise from their home. They were sleep-deprived and very angry. They even suggested selling the home right away, as they just cannot deal with the neighbor.
This is NOT what you expect with first-time buyers and the euphoric feeling of buying their first home. This sure burst their balloon!
I always recommend buyers driving around the home on Friday and Saturday nights to see if there are wild parties, noisy neighbors, etc., but never have I suggested driving by at 2 am!
