The U.S. House of Representatives passed a series of bills on Wednesday night that included the ALTA-supported Securing and Enabling Commerce Using Remote and Electronic (SECURE) Notarization Act (H.R. 3962), according to a news bulletin we received from American Land Title Association.

The SECURE Notarization Act would –

  • Permit immediate nationwide use of remote online notarization (RON)
  • Create national minimum standards for its use
  • Provide certainty for the interstate recognition of RON

Passage of the SECURE Notarization act paves the way for national RON legislation, which would simplify and standardize electronic, remote closings for homebuyers and sellers everywhere. Several states have RON legislation on their books, including Virginia and Maryland. DC does not yet have a law.

The real estate industry is rapidly transitioning to cater to a technologically savvy market. We began partnering with multiple providers and investing in software years ago to ensure we would be ready when our clients demanded remote closing capabilities.

We’re one step closer this week with the passage of the SECURE Notarization Act in the House, and we’ll keep you apprised of updates as we receive them.
