Get it in writing

4 words... $10,000!

One of my agents has just had a transaction which cost him $10,000 of commission because he didn't heed those 4 big words..."Get it in writing".  The agent was told by the listing agent that the seller would agree to a certain price, and for the buyers agent to send over a counter at that price... which would then be approved by the seller.  The buyer's agent did so, and by the time the seller was told of the new offer, he had decided that he didn't want to go that low on his price after all (even though he was agreeable to it just 2 days earlier). He's still working on finding them another home, but the client was almost soured out of looking because of the disappointment.

LESSON:  If the buyer's agent would have said, "That's terrific, when can you get me the counter offer signed by the seller so I can have my buyer approve it?"  Done deal!  The seller was ready and willing to sign at the acceptable price to both parties.  And once he had signed, the buyer could have held him to the contract, and the buyer and buyer's interest would be protected.

Don't forget.... GET IT IN WRITING.

Ouch! That was a costly mistake and one that likely they will remember for a long time. If it is not in writing it does not exist.

It was done a little ass-backwards... but what kind of listing agent would put the creation of a counter in the buyer's agents hands?  And would such an agent have gotten it signed by the seller any sooner?
