Wayne Martin - in appreciation for your participating in the March to a Solution|ActiveRain March 2003 Challenge, Kathleen Daniels, Probate & Trust Specialist and I virtually present to you two hands full of glittery gold coins! May you enjoy them and spend them anyway you want! Perhaps tonight with some good libations?  

In your last entry, we wish to say, congratulations on winning your case! Having been "the Managing Broker of a large Real Estate Office of a National Franchise affiliation, and having intimate knowledge with the law, why would anyone be bold enough to take you to court? There was no evidence that they were right and your agent was wrong. They must have been crazy to take you to court and think they could slap you in the face. Case Law prevailed and you must have felt ten feet tall after it was all over. 

Wayne, even though you completed the three entries, which we are very grateful for, it would be really nice if you can provide future case studies like this so that members here on ActiveRain could learn from true stories. As agents, we cannot practice law but there are enough agents out there all over the map of the United States who know how to bully and throw their weight around. 

For now, what you have shared are stories to be treasured and remembered. In business, there are always gray areas and the truth is seldom simple. Most agents are told, document, document, document. Is that all there is, or is there a blueprint or template for documenting to stay out of trouble? Truly, you are appreciated and it was so nice for to be human, and share that as a Broker, you were responsible for the actions of your agents. On rare occasions, things go haywire, for agents, and it feels like one is going into a battlefield, which is crazy and scary too. Well, I won't push the envelope. These three examples you shared were a gift.

I think Kathleen and I speak for everyone here on ActiveRain - We love that you are still here on ActiveRain! Thank you for completing the three outstanding entries for this March Challenge. Wayne, you are appreciated!

George Souto - When you think about it, I think Thomas J. Nelson, REALTOR ® e-Pro CRS RCS-D Vets commented, we could have an AR library to go back to for reference. 

The entries have not been disappointing at all and each one is so different and relatable!

So far, we don't have any Mortgage Lender stories or Home Inspectors\ stories either. Perhaps you can share some stories you remember from 2008? I'll bet that would be very educational for agents who never experience that era of misery for all. 

Something said at the end of every closing to the buyers here in TX in my area, is if you don't pay, you don't stay.

I confess I am surprised by the number of entries posted thus far and how many people have completed all three entries. I check every day, sometimes a few times a day to see if anyone posted a new entry. I am that excited to read them.

Kathleen Daniels, Probate & Trust Specialist - What impressed me the most is that everyone has their own voice and their own unique stories. Many of those stories resonate with me and I am sure with others too. I love that we are being so open and honest about the lessons we learned. 

In real estate, learning never ends. I am thrilled by the number of entries. It has been a wonderful experience and the sharing is so good for our hearts and souls.

Good morning Patricia. Thank you for the shout out. Truthfully, the legal wizardry in this case came from our counsel. It was so frivolous that our attorney did a little extra research to find a little known case and we pursued our rights.. Bravo to him.

Wayne Martin - thanks for 'truthfully," disclosing who the "legal wizardry in his case," was which is good to know because in the real estate industry, to be the best, we have to surround ourselves with the best Team and people we know, like, and trust.

Wayne Martin Congratulations on winning this challenge!  I missed the whole thing this month but am going back to read it.  You know if it involves the law, I'm interested.
