Opening a New Brokerage

Ok I went out and started the process of opening a New Brokerage, and in a down market to boot!   Gasp!

Why?  My current Broker is down sizing and has no need for all of the Brokers he hired in the boom years.  He is upset he has to down size.  So am I.  I am loosing the over ride on several agents I poured 100s of hours of training into.  But that is the way our business goes.  Expand too fast and the market tweaks your wallet.  Expand too slowly and the market misses your wallet. 

So in the last 5 days I have....

  • Registered a Trade Name
  • Registered several urls
  • Hired a Lawyer
  • Started paper work on forming an S-Corp:  an eligible domestic corporation can avoid double taxation (once to the shareholders and again to the corporation) by electing to be treated as an S corporation. Generally, an S corporation is exempt from federal income tax other than tax on certain capital gains and passive income. On their tax returns, the S corporation's shareholders include their share of the corporation's separately stated items of income, deduction, loss, and credit, and their share of nonseparately stated income or loss.
  • Negotiated a 3 year lease in down town Hilo on Keawe Street. (It took about 36 hours of gentle but firm negotiations)
  • Met with the tenants in the building.
  • Assembled a sole source computer and printer equipment budget for Dell.  
  • Assembled an over head budget to estimate the hit to my pocket book for the next 3 years.
  • Assembled a commission plan married with profit sharing. 
  • Hired a graphics artist to lay out the space, modify my existing business card, and create a company logo.
  • Hired a good general contractor to implement the floor design.
  • Ordered voice/DSL line + rotating phone lines + new handsets.
  • Ordered the power to be turned on --- construction starts Monday.
  • Ordered E&O forms for insurance.

Business Plan:  (Hawaii Law requires a physical address so I must establish a physical address.)  Market Hawaii Real Estate via location specific web sites thru my agents.  Once I complete my local office with the reliable and redundant infrastructure (desks, computers, printers, secure internet and office supplies), I will go to next town.  Each agent hired will be given exclusive use of a web site to farm that specific area or town.  Each agent will also be a resident of that area or town.  Provide each agent with photographic, 360 tour and sales brochure support.  Use valid xhtml and css for each web site.  Stream line the code for fast down loads. Correctly format each web site so it will be searchable by its location or city name and place in the 10 ten of the major search engines within 6 months.  Commission checks will by direct deposit.  Company files will be stored on CD.  Meetings will be conducted via video on internet.  I shall provide one on one training.  My Company will offer only 4 commissions.  65%( new but must have a mentor who will collect 15% for 1st 5 deals), 70% (minimum requirements 2 yrs +12 closings), 75% (2yrs+ 12 closings + ABR), 80% (2 yrs + 24 closings + ABR + GRI).  I shall collect a 5% override for my investment.  5% shall pay for the office overhead, the remaining 10% shall be distributed as profit sharing.  Advertising funds shall not be spent on (OPTs) Over Priced Turkeys.  My job is simple.  Advise, enable and fully support my agents.

John - What made you decide that the agents needed to have the designations?  For example, I can't work for you at the higher rates without an ABR.  I don't work with buyers.

I am also trying to figure out structures for agents.  I had thought that requiring specific licenses (auctioneer for example) or designations would hinder.  I do agree on the number of transactions though.

Thank you for your comments. 

Many of us who may need medical help look for board certified medical professionals.  We do it because we believe the medical professional has made the effort to reach a higher standard.  We believe the higher standard will give us better service.  As I review your area of expertise I realize my model might have to be tweaked to work with an area an area like yours.  

The bulk of transactions here on the Big Island of Hawaii are residential.   For the ABR criteria I have three reasons.  1) For every seller there is a buyer. 2) Understanding buyer needs will facilitate a smoother transaction even if you are a listing agent.  3) Our profession may soon change to where the listing Brokerage may not offer a fee to the Buyer’s Broker.

For the GRI…Way too many folks in our profession hang out their shingle and never take another course beyond their continuing education requirements.  The GRI puts meat on the bare bones of the license courses.   Education is just a process of gathering tools that we may need in a future transaction.  Way too many agents want to learn on the client. 

Imagine how we would feel if our medical professional said to us, I have not done this before but you can trust my enthusiasm!

The "soft opening" of my new office should happen on April 16.  Today we carried 75 cases of Travertine tile up the stairs....so now I don't have to go to the gym HA!  (where is my cold beer?) 

Whooo hoo just received the Sole Proprietor License (I will switch to S-Corp later next month...had to do this because of the time delays that might have been incurred - I could not take the chance of making a mistake with the RE commission and licensing folks, so one step at a  time to keep things simple for them and me.)  

Agent Work Area- each agent work area will have about 15 sq ft of flat surface that is 28 inches off the floor, two internet connections, one multi line phone connection, one open air file system, one computer w/20 inch wide screen monitor and one mesh backed office chair.  Each desk will be illuminated with its own over head 4 ft full spectrum light that an agent can control.  Agent work areas will be separated by a knee wall that is 5ft long and 5 ft high. 

Equipment- I spent way more hours than I want to admit researching the equipment -- our electricity costs about $0.35/KwHr I just had to make sure the appliances, internet and computer systems were energy star rated.   The equipment is now pouring in....most of it with free shipping - which is wonderful considering we sit in the middle of the pacific ocean!

One archival digital sender has been received.  Push a button and off to any place in cyber space or fax land goes 50 pages.

One multi function color laser printer (fax, copy, scan and print) with extra 500 sheet capacity and memory is due in.

One dedicated high duty cycle color laser with extra 500 sheet capacity for every day work group printing - mfgr claims a duty cycle of 95K pages/month at 0.009/pg black and white & 0.067/pg color).

Four computers with XP - I won't even consider Vista until next year.  Four more will be placed on order next month.  The computers have a lead free mother board and heat sensors in the mother board to turn on different fans to cool more. 

Three 5 ft ceiling fans will move the air around the office (the office is naturally cooled by ocean breezes).  However, I have installed the electricity for a 15,000 btu efficient A/C unit just in case.

One 40 inch LCD wall mounted monitor has been received and will be installed in the conference room.  As I looked at round tables I soon realized that our table needed to be sold,  project trust and team work.  Given the costs were very close I ordered one to be made from a local artist who started a blog about it

The wood is cypress and it was felled in Mountain View here on the Big Island two weeks ago.  The root ball wood was found washed up on a beach some where on the North West side of the Big Island.

One DSL/Fax line and two voice lines have been installed (the office is being wired for 4 voice lines on an electronic rotary system.  The phone hand sets have been received (I will have to go to read the manual for year to learn how to use them --- they have head sets, caller ID, 3 way conference and transfer capability.) 

Internet and LAN

  • One ADSL2+ modem has been received.
  • Three 8 port gigabyte switches have been received
  • One stand alone wireless access point with external antenna should be in by Monday.
  • One 8 port gigabyte router has been received.

Preliminary Branding

One company logo was commissioned.  It was carefully designed by a graphics artist and delivered (the logo will be copyrighted and registered).

4 sets of business cards were commissioned. They were carefully designed by the same graphics artist and placed on order via internet yesterday.  

Next week I will send ZipForm our new logo to be placed on all contracts. 

Managing contracts - am working with ZipForm on uploading our new logo and enrolling in RELAYTM.  RELAYTMis online Transaction Management System that is supposed to streamline workflow and collaboration between the agents, other professionals, and clients throughout the real estate transaction. RELAYTM tracks and manages all transaction information and activities from listing though closing, including: listing and sale information, transaction contacts, documents, client satisfaction, and all communications throughout the transaction.

We have completed work on our local addenda we attach to our contracts.  Hawaii county, Flood Zone and Power. These forms have pop down menus.

Professional Support- Retained a Real Estate attorney, an Enrolled Agent and a CPA.

My "to do" list has the following items on it:

  • Install and configure the high speed LAN w/wireless access point & antenna
  • Install and configure the digital sender.
  • Install and configure the multi-function color printer
  • Install and configure the work group printer.
  • Install and configure the phones and voice mail.
  • Up date 14 web sites with the new company info
  • Complete the S-Corp Registration
  • Create a new web site for the office.
  • Work on the policy and procedures manual
  • Research and order wireless mouse and key board for conference room.
  • Complete the 20 inch lcd monitor order (had to have 800:1 contrast ratio, high resolution , 5ms response time and consume little power.
  • Pick up 12 office chairs (already on order)
  • Order a document shredder
  • Complete application for EE & O. (This happens when the policy manual is completed so I can supply them a copy for the best coverage and rates.)
  • Look into office liability insurance.
  • Order REALTOR® & ABR® brochures
  • Complete the design on the document presentation folders and put them on order.

Aloha John, you forgot to mention that while you are doing all of this you are still being Principle Broker to us agents (Some of us apparently need more brokering than others, thanks for the data analysis and excell formatting!) and working your own real estate listings/buyers as well...LHRE has already had its first transaction close! Get some sleep for goodness sake!

I am excited to get to work each day...thanks for your enthusiasm and assistance! Heres to that next closing! You buy the beer and I'll get the pupus...

Tested a new high gain antenna today for the wireless.  Now we can take clients to Subway down the street for a sandwich and still talk business!  I sat at each table and was able to log on to the internet.  The poorest reception came from the table furtest in the back.  There is a wall and an airconditioning unit between the table and the 7db antenna.

The 7db gain antenna has almost doubled the range.  However, due to the frequencies used by wireless systems the system is a line of sight system.  In other words if you can see the antenna you will be able to lock into good signal strength.

Nearing the 6 month mark.  Now have 4 agents.  Our sales are just over $1,000,000.  So we are paying the bills. Most of our deals are land deals.  We are staying away from home sales for the time being.  Still need to hire a CPA.  Have a good lawyer.  Hawaii Telcom still does not have the telephone bill correct.  We have added several web sites.  Other wise it has been quite a challenge and and great fun to work wiith very nice folks.

    Keep in mind that the Big Island of Hawaii is about 4024 Sq Miles in Size, Puna is about 500 Sq Miles in size.  We fully expect to see 30% of Agents on the Big Island of Hawaii go inactive this next license cycle.

    Wow John,

    Ok, four years later, market has still not taken a turn for the better.  I must ask, how are things going with you  now?

    What adjustments have you made to your business, since its inception 4 years ago?  Do you have more agents? Are you still in your office?  Is everything paid for?

    I'm joining a company that has asked me to be their managing broker and these are the questions that I have running through my mind.
