A friend of mine asked me yesterday if I had ever heard of covenants in a subdivision expiring and no longer being valid. Well yes is the short answer. At least here in Montrose Colorado there are subdivisions that were built in the 70's and 80's where the covenants expired 20 or 25 years in the future. Which I am sure back then it seemed like a good idea.

Of course that 20/25 years is now here. Well the covenants in the subdivision my friend lives in is one such instance of them expiring. At the time this subdivision was built it was the premium place to live, and still today there are some very nice homes even though the area has been surpassed by far nicer subdivisions.

So now there are no covenants, not that everyone is going to junk the place up. He was telling me that most of the homeowners want to re-record the covenants with a few updates and changes nothing major however getting 100% to agree is turning out to be a challenge. So beware if you live in an older area look and see if your covenants are going to expire. All covenants these days run forever. www.MontroseHomeConnection.com

Alan-- this is really interesting.  Did the covenants actually have a provision or a date to expire? We have some areas where they are not enforced, no association exists, but the covenants are still on record at the County.
